Table of Provisions (6)

Statutory Text (6 Provisions)

1. The instruction and judgment of cases handled by the Neutral Tribunal give rise to the charging of a fee, as well as the recovery of expenses they have incurred.

2. The fee covers the operations carried out by the Tribunal.

3. The expenses (or disbursements) consist of amounts paid by the Neutral Tribunal to third parties for the completion of certain operations. They notably include expert fees, witness indemnities, and other expenses incurred in the administration of evidence. They are added to the fee.

4. The amount of the fee and expenses is determined by the decision of the Neutral Tribunal concluding the proceedings.

1. In matters of recusal, the fee is set up to a maximum amount of CHF 3,000.

2. When the Neutral Court conducts proceedings and adjudicates the case in place of the disqualified authority, the fee is calculated according to the tariff applicable to the disqualified authority.

1. The amount of the fee is determined taking into account the difficulties and scope of the required operations, as well as the interest of the parties involved in the case.

2. In matters of disqualification, the fee may be increased by up to 50% beyond the maximum provided in Article 2, paragraph 1, in the presence of particular difficulties. Conversely, it may be reduced or even waived in particularly straightforward cases or for reasons of equity.

1. If expenses must be incurred by the Neutral Tribunal at the request of a party, particularly in the administration of evidence, the requesting party may be required to advance these expenses.

1. Reserved remains the collection of chancellery fees, notably for the delivery of copies or certificates, the consultation of files related to a liquidated case, the communication of judgments or information, and research in archives.
