Statutory Text (3 Provisions)

1. The instruction and judgment of applications to the Constitutional Court result in a charge of 500 to 5000 francs, as well as the recovery of expenses incurred.

2. The same applies to appeals lodged with the Court against decisions related to the validity of a popular initiative or in the case of applying Article 121a, paragraph 2 LEDP [B].

3. Judgments of the Court adjudicating a jurisdictional dispute do not give rise to fees, except in the case of a frivolous appeal to the Court by a party.

4. The charge covers the operations carried out by the Court.

5. The expenses (or disbursements) consist of amounts paid by the Court to third parties for the accomplishment of certain operations.

6. The amount of the charge and expenses is determined by the judgment or by the decision of the instructing judge concluding the procedure.

1. The amount of the fee is determined by taking into account the difficulty and scope of the required operations, as well as the interests of the parties involved in the case.

2. The fee may be increased beyond the maximum provided in Article 1, paragraph 1, in the presence of particular difficulties; conversely, it may be reduced below the minimum amount provided by the same provision, in particularly simple cases or if equity so requires.

3. The fee is also reduced when the case is settled before judgment.

1. This tariff repeals the regulation of November 30, 2004, on the fees and charges levied by the Constitutional Court.

2. It shall enter into force on January 1, 2008.
