Statutory Text (6 Provisions)

1. A fund is established for the purpose of financing the cantonal asylum policy (hereinafter referred to as "the fund").

1. The fund is annually supplied by contributions from the Vaud Foundation for the Reception of Asylum Seekers (FAREAS) to the department according to the terms and conditions stipulated by the Convention and its annexes of March 24, 2000, concluded between the State of Vaud and FAREAS, as well as by any other contribution, deduction, donation, legacy, or restitution in accordance with the purpose of the fund.

1. The fund aims to strengthen financing in the asylum sector, to the extent of available amounts, for

a. specific schooling and training for asylum seekers, subject to Article 114 b of the School Act [C];

b. operating costs of the specific reception centre for unaccompanied minor asylum seekers under the canton's responsibility;

c. assistance and return aid for asylum seekers in accordance with decisions of the Council of State;

d. investments made to date, acquisitions or leases of properties for the accommodation of asylum seekers, which must be reimbursed to the Confederation;

e. integration programs for refugees domiciled in the canton, who have been granted asylum in Switzerland;

f. individual aid not fully reimbursed by the Confederation;

g. administrative costs (mandates) borne by the State in connection with the control of the execution of agreements and service contracts.

1. The fund is recorded on the State's balance sheet. For accounting purposes, the gross method principle is applied according to Article 14(a) of the Finance Act of November 27, 1972 (LFIN) [D], which mandates the prohibition of offsetting between assets and liabilities as well as between expenses and income. The expenditures covered by the fund appear in the State's ordinary budget in accordance with Article 6, paragraph 1, LFIN, or are subject to an additional credit as per Article 11 LFIN. The revenue from the dissolution of the fund is governed by the same principles.

2. The administrative and financial management of the fund is ensured by the department, or, respectively, by proxy of the head of the department, by the Population Service (SPOP).

1. The head of the department decides to finance specific expenses by drawing from the fund under the framework of these regulations, upon proposal by the SPOP. The SPOP examines any proposal it receives and submits them to the head of the department with its prior notice.

2. The head of the department may delegate his/her powers to the head of the SPOP to finance individual aids that are not covered by either the Confederation or the canton under existing schemes.

1. The department is responsible for the enforcement of this regulation, which shall come into immediate effect.
