Act on the Financial Support of the Altdorf Swimming Pool (Swimming Pool Financing Act) (Schwimmbadfinanzierungsgesetz) - Purpose
Table of Provisions (12)
Statutory Text (12 Provisions)
1. This law governs the long-term financing of the substance-maintaining investments of the Altdorf swimming pool by the canton and the municipalities.
1. To finance benefits under this law, the Canton shall establish a Swimming Pool Fund.
1. The Canton and the municipalities annually contribute to the Swimming Pool Fund with donations.
1. The annual contribution of a municipality is determined by its population size and the spatial distance to the swimming pool.
2. Depending on the spatial distance to the swimming pool, the municipalities are divided into the following tariff zones
a) Tariff Zone 1: Altdorf, Attinghausen, Bürglen, Erstfeld, Flüelen, Schattdorf, Seedorf
b) Tariff Zone 2: Bauen, Gurtnellen, Isenthal, Silenen, Sisikon, Spiringen, Unterschächen, Wassen
c) Tariff Zone 3: Andermatt, Göschenen, Hospental, Realp, Seelisberg
3. Depending on the tariff zone, the municipalities make the following contribution per inhabitant
a) Tariff Zone 1: 7 Swiss Francs
b) Tariff Zone 2: 5 Swiss Francs
c) Tariff Zone 3: 3 Swiss Francs
1. The canton shall annually contribute an amount equal to the total of the municipal contributions.
1. The competent directorate calculates the amount of the contributions every four years based on the average permanent resident population of the last four years.
2. It invoices the contributions annually at the beginning of the year, for the first time in the year 2017.
3. When reassessing every four years, it adjusts the contributions for inflation (baseline: Zurich Construction Cost Index as of January 1, 2017).
**1. The Government Council shall submit a report to the Cantonal Council every four years on the condition of the Swimming Pool Fund, the expenditures made, and the expenditures planned, for the first time in the year 2020. Based on this report, the Cantonal Council may adjust the contributions to the Swimming Pool Fund as follows:**
a) The contributions shall be oriented according to the investment needs of the swimming pool for the next four years.
b) The reference size for annual investments until the permanent cessation of the swimming pool operations is 460,000 Swiss francs. The total of municipal and cantonal contributions may not exceed or fall short of this size by more than 25 percent, after taking inflation into account.
c) The ratio between contributions per inhabitant (Art. 4 para. 3) and between municipal contributions and the cantonal contribution (Art. 5) must remain the same.
1. To provide initial funding, the canton may grant interest-free loans to the swimming pool fund.
2. The repayment of these loans shall be effected through offsetting with the cantonal contributions in accordance with Article 5.
1. Benefits from the swimming pool fund are granted on the condition that the municipalities are allowed to jointly elect at least one person to the board of directors of the Altdorf swimming pool.
2. Benefits from the swimming pool fund are allocated exclusively for tied expenses that contribute to the maintenance of the Altdorf swimming pool's substance. Thus, the fund benefits expressly exclude the financing of operating and maintenance costs as well as new investments.
3. The government council has authority over the swimming pool fund.
1. If the Altdorf Swimming Pool permanently ceases the operation of the existing pool, no further contributions are to be made to the swimming pool fund, and the swimming pool fund is to be dissolved.
2. Unused funds are to be reimbursed to the canton and the municipalities in proportion to the contributions made in total.
1. The procedure is governed by the Ordinance on Administrative Jurisdiction (RB 2.2345), unless this law provides otherwise.
1. This law is subject to a referendum.
2. It shall enter into force on July 1, 2016.
