Regulations concerning promotions for uniformed personnel of the Cantonal Prison Facilities

The present regulations, in compliance with Art. 54 para. 7 of the Regulations for State Employees of 11 July 2017 (hereinafter RDSt), govern the hierarchical structure and promotions of uniformed personnel for the Correctional Facilities of the Canton of Ticino.

1 Promotions based on seniority are granted automatically, subject to a favourable recommendation issued by the executive officer.

2 All promotions concerning correctional officers are conditional upon obtaining the federal professional certificate as a correctional officer, issued by the Swiss Centre for the Training of Prison Staff.

3 Promotions based on career path are subject to an internal competitive tender and are subject to the following conditions

a) being included in the internal career path;

b) having achieved at least an overall level "C" in the periodic evaluation over the last 2 years; superior performance constitutes a preferential qualification;

c) being appointed to the hierarchical position immediately below the position for which the candidacy is submitted;

d) not having incurred a sanction as a result of a breach of service duties within the meaning of Articles 32 et seq. of the Law on the Organisation of State Employees and Teachers of 15 March 1995 and Articles 41 and 42 RDSt in the last two years. For the computation of the period, the closing date of the competition shall be authoritative;

e) not having suffered a criminal conviction related to offences incompatible with the function of a correctional officer in the last two years. The executive officer determines the admissibility of the candidacy based on the gravity and/or nature of the offence committed and recidivism. For the computation of the period, the closing date of the competition shall be authoritative;

f) no unjustified ongoing enforcement procedures and absence of certificates of insolvency;

g) no limitation on working shifts and/or during the working hours provided for the position;

h) no limitation regarding the assumption of operational duties provided for the position;

i) no limitation regarding deployment in the different sectors of the prison facilities.

1 The promotion from central operator in training to central operator occurs under the terms provided in the governmental resolution concerning the selection, hiring, and training of custody officers and central operators for the Penitentiary Facilities of the Canton of Ticino.

The Director of Prison Facilities rules on the assignment of ranks and qualifications for the respective functions and issues the necessary directives.

Entry into force

This Regulation shall be published in the Official Bulletin of Laws and shall enter into force on 1 January 2018.
