Table of Provisions (55)

Statutory Text (55 Provisions)

RCCP

1 This regulation establishes the rules and organization of the Cantonal Multipurpose Center of Camorino (CMC). Where necessary, the Director of the Center issues detailed provisions.

2 It applies to staff and to all persons accommodated in the Center. The regulation is also valid for minors, subject to any specific provisions foreseen by the current legal framework.

RCCP

1 The Centre is primarily intended to accommodate persons allocated to the Canton Ticino within the scope of asylum. The Centre’s guests shall, in principle, include persons

a) whose asylum application has not yet been processed (N permit);

b) whose admission has been provisionally granted (F permit);

c) who benefit from refugee status and a right of residence (B permit);

d) who benefit from provisional protection (S permit), as a possible reception point for the “reception plan” established by the Council of State.

2 The Centre may also be used for other protection purposes, subject to authorisation by the Director and the Head of the Military and Population Protection Section. In such a case, an agreement may be stipulated, defining in particular the duration and intended use.

3 Should the State Secretariat for Migration issue a decision of inadmissibility (NEM) or a negative decision with referral against a guest, that guest may no longer be accommodated at the Centre from the date the decision becomes legally binding.

The Director may grant an exception, allowing the guest to remain in the Centre for a maximum of 60 days after the decision becomes legally binding, only on condition that a decision for allocation to new accommodation has been issued by the URAR.

RCCP

In these Regulations, the following definitions apply

- Department: the Department of Institutions;

- Section: the Section for Military Affairs and Population Protection;

- Centre: the Cantonal Multipurpose Centre of Camorino;

- Director: the Head of Office of the Cantonal Multipurpose Centre of Camorino;

- Beneficiary: the person assigned to the Accommodation Centre within the meaning of these Regulations;

- Staff: persons professionally subordinate to or at the disposal of the Director;

- Security Staff: staff of the Cantonal Prison Facilities assigned to the Centre and staff of the private security company operating in the Centre under a cantonal mandate;

- Integration Body: the body that, under a cantonal mandate, guarantees social support and integration assistance for beneficiaries in collaboration with the Centre's staff;

- URAR: Office for Asylum Seekers and Refugees.

RCCP

1 The Centre is placed under the management of its Director.

2 The Director is subordinate to the Section.

3 The regulations must be applied impartially. No one may be discriminated against, in particular on account of origin, race, sex, sexual orientation, age, language, social position, way of life, religious, philosophical or political convictions, or physical, mental or psychological impairments.

4 Personnel, with regard to minors, act in concert with the competent authority.

RCCP

1 A person, in accordance with Article 2 paragraph 1, can only be admitted to the Centre following an assignment by the Office for Asylum Seekers and Refugees (OASR). At the time of assignment, the OASR, or the integration body acting on its mandate, transmits to the Centre the guest's data, such as personal, social, health, and interpersonal relationship details.

2 The beneficiary is welcomed by the staff and provides all information useful for the creation of the individual file. In particular, they authorize the staff to photocopy their documents.

RCCP

1 Information concerning the beneficiary must include, in particular

a) data on the beneficiary's identity, marital status (including information relating to the spouse), family relationships, and any minors under their guardianship;

b) the date and time of the beneficiary's arrival at the Centre;

c) information on visible injuries or allegations of mistreatment;

d) any useful information on the beneficiary's physical or mental health status;

e) information on the educational or professional background in the country of origin;

f) linguistic knowledge;

g) any other relevant information.

2 The Centre maintains an individual file for each beneficiary, composed of the information collected upon reception and any useful documents. The file is also stored digitally on the Tutoris application.

3 After departure, the beneficiary's individual file is kept by the Centre, in digital format, for at least five years.

RCCP

1 The beneficiary must be informed of their rights, and of the laws, norms, and rules that apply depending on their legal status and within the Centre.

2 Upon the beneficiary's arrival, staff conduct an initial interview where basic rules are explained using a simultaneous translation device.

3 Staff summon the beneficiary to whom, with the support of the integration body and potentially with the assistance of an interpreter, in a language they understand, the following will be explained, specifically

a) the rights and duties within the facility;

b) the management system of the Centre and the facility, including these regulations;

c) the provisions concerning refugee management on cantonal territory.

At this point, the beneficiary will be required to sign the documentation pertaining to their stay.

4 A copy of these regulations and the main applicable asylum laws is available at the Centre's reception.

RCCP

1 Upon the beneficiary's arrival at the Centre, a check of their belongings (bags, suitcases, etc.) may be carried out. Such belongings may be subjected to a quarantine period for health, veterinary, or other reasons of collective interest.

2 All personal belongings remain at the beneficiary's disposal, unless security reasons prevent it.

3 Belongings that cannot remain at the beneficiary's disposal are withdrawn and kept in custody for the duration of their stay at the Centre.

4 Staff shall prepare a comprehensive inventory of the withdrawn effects; the inventory shall be signed by the staff and the beneficiary, who shall receive a copy thereof.

5 Perishable goods that are not permitted may be destroyed; the inventory must list them.

6 Category A and B medications (according to the indications of the Federal Office of Public Health) shall be withdrawn, unless a specific medical prescription justifies that they remain with the beneficiary. If circumstances justify it, staff shall immediately contact a physician to verify the possibility for the beneficiary to retain possession of a medication for which they do not have the specific medical prescription.

7 Electrical equipment that does not comply with standards, is in poor condition, or is considered dangerous is prohibited and may therefore be withdrawn.

8 The beneficiary is responsible for everything that remains in their possession.

RCCP

1. The possession, carrying, manufacturing, and in any case the introduction into the facility of weapons and dangerous objects, capable of being improperly used as weapons (including throwing knives, etc.), are strictly prohibited. Exceptions are made for utensils used in the kitchen or in other activities, subject to prior authorization from the Center's staff.

2. In case of violation of this rule, such objects will be immediately confiscated.

3. Staff are required to notify the authorities of the possession of weapons for appropriate verification.

4. Any compensation for confiscated objects and weapons is excluded.

RCCP

1 The possession and introduction of animals into the Center are prohibited.

2 The violation of this rule entails the confiscation of the animal according to the instructions of the Cantonal Veterinary Office.

3 The Director may grant exceptions for proven medical reasons. In such a case, in agreement with the Cantonal Veterinary Office, the animal will be subjected to the necessary health checks.

RCCP

1 Each beneficiary is assigned a housing accommodation.

2 Upon delivery of the housing spaces, an entry report is drawn up in the presence of the beneficiary and a staff representative, who sign it in duplicate, one copy for each party.

3 Upon leaving the Centre, or in the event of a change in housing accommodation, an inspection of the condition of the used housing spaces is carried out, which is recorded in an exit report prepared in duplicate. The beneficiary is required to return the housing spaces in the condition in which they were received. In case of non-compliance with this provision, the cleaning costs and restoration works shall be borne by the beneficiary.

4 Any requests for modification concerning the arrangement of furniture in the rooms must be submitted to the staff, who will assess their feasibility and relevance.

5 In order to ensure the safety and physical integrity of beneficiaries and staff, rooms and lockers may be inspected by authorized personnel, the Director, or the police at any time, without prior notice.

RCCP

1 Final departure from the Centre is subject to the allocation of individual accommodation or a place in another collective facility by the URAR, or to a decision by an administrative or judicial authority.

2 The beneficiary shall have returned to them the items they were unable to keep personally upon their arrival, and which were stored in accordance with the provisions of Article 8, without prejudice to the provisions of Article 9. They must sign a receipt for the returned goods.

RCCP

1. **Principle:** The beneficiary is initially placed in a basic regime: a bedroom without a kitchen and without private sanitary facilities. If special conditions make it strictly necessary, for example for health reasons, the beneficiary is placed in shared accommodation or an apartment.

2. A family unit may be placed in an apartment, subject to availability.

3. The beneficiary may be placed in an apartment, subject to availability, if accompanied by a minor child.

RCCP

1 Initially, beneficiaries who have resided in the Center for several months and who, following the integration process, demonstrate greater autonomy are placed in shared accommodation, subject to availability.

2 These accommodations feature shared areas that may be made available to beneficiaries if the Director deems it appropriate.

RCCP

1 Beneficiaries who demonstrate a good level of autonomy are, in principle, placed in an apartment within the Centre, subject to availability.

2 The Director has the faculty to keep up to a maximum of two apartments vacant for needs related to population protection.

RCCP

The Director decides on changes to the accommodation regime after consultation with the Body responsible for integration.

RCCP

The beneficiary is informed that the URAR may transfer them to another center in the Canton based on their integrative pathway, for logistical, security, health reasons, or for other needs.

RCCP

1 The issuance of detailed rules pertaining to occupancy and life in the accommodation centers falls within the competence of the Director.

2 In the absence of different regulations, beneficiaries are required to return to the Center by 11:00 p.m. The Director is authorized to grant exceptions.

3 The use of mobile phones within the Center is generally authorized.

q) not to engage in conduct that could endanger one's own integrity or that of other persons or property.

RCCP

1 The beneficiary is responsible for the daily orderliness and cleanliness of the living spaces assigned to them.

2 They must take care of the premises, equipment, furnishings, and objects belonging to the Centre.

3 It is possible to decorate the living arrangements by hanging, to a limited extent, pictures, images, or other items; however, these must not offend other beneficiaries or staff. In such a case, the Director reserves the right to remove any displayed items. In any case, they must be able to be hung and removed without damaging the walls. It is forbidden to write or draw on walls, partitions, doors, furniture, and equipment.

4 Each beneficiary must contribute – within the limits of their physical and mental capacities – to the cleaning of common areas. The staff will establish shifts for the cleaning, maintenance, and tidying of common areas (kitchens, showers, bathrooms, corridors, stairs, offices, outdoor spaces, etc.). The work will be carried out in groups during daily activity hours. This management aims to enhance the integration process. The contribution provided will be financially compensated as indicated in Article 38.

RCCP

Each beneficiary is required to dispose of their waste in a suitable, appropriate manner, and in particular through separate collection, making use of the designated containers and following the procedures set forth in the Center's directives.

RCCP

1 The beneficiary is obliged to report damages. They are liable for any damage caused intentionally or through negligence.

2 Compensation for damage caused intentionally or through negligence is due irrespective of any criminal or disciplinary measures.

RCCP

1. **General Principle**: The use of mobile phones and electronic devices is permitted within the Centre.

2. If the proper functioning of the Centre requires it, the Director may limit their use.

3. Filming, audio recordings, and photography are prohibited inside the Centre. In particular, it is forbidden to photograph and film the facility, staff, and beneficiaries. Therefore, sharing any audio/video content concerning the Centre, its guests, and staff on social media and the internet in general is prohibited.

4. Violation of this rule may result in the temporary deprivation of the mobile phone or other devices.

5. Each beneficiary is required to respect the use of the internet, social media, and any communication tool, as well as the physical, psychological, and sexual integrity of individuals.

6. It is strictly prohibited to use such tools to disseminate racist, xenophobic, or hate messages, or messages inciting violence of any kind, or discrimination. Furthermore, it is forbidden to express sympathy for individuals, organizations, or states that violate human rights, personal freedom, religious freedom, or any other fundamental right.

7. In case of violation of this article, the communication device may be confiscated and, if applicable, handed over to the competent authorities if there is a concrete suspicion of a crime. In no case shall the beneficiary be entitled to compensation for the confiscation.

RCCP

Video or photographic recordings may be authorized by the Director for security-related purposes, for educational reasons, and for the promotion of the facility. In these latter two cases, the consent of the interested beneficiaries is also required.

RCCP

1. Clothing must always be appropriate for the circumstances.

2. The Center provides a basic package (clothing and personal hygiene products) to beneficiaries who do not possess them.

3. Based on the clothing available at the Center, beneficiaries will have the opportunity to purchase other items of clothing within the Center at a symbolic price.

RCCP

1 The consumption, possession, and trafficking of narcotic substances are prohibited in the Centre.

2 In the event of suspected or ascertained violation, personnel are obliged to immediately notify the competent authorities.

3 For this purpose, the Director may decide to carry out targeted checks.

RCCP

Outside of the specially designated areas, smoking or using electronic cigarettes is not permitted.

RCCP

1. The Center is equipped with a fire alarm system. All beneficiaries are obliged to participate in the drills regularly organized by the Center's managers. Such drills may also be extended to other potential dangers. In the event of an actual danger, beneficiaries are required to follow the instructions of the staff and those of the first response agencies.

2. Improper use of the alarm system is strictly prohibited. Costs incurred due to the intervention of first response agencies, for the restoration of the system, or any other cost voluntarily or negligently caused, shall be borne by the responsible party.

3. In case of non-compliance with the above, the Director may take appropriate disciplinary measures as provided for in Article 52.

RCCP

1 For the purpose of ensuring security, beneficiaries, the spaces assigned to them, together with the objects and electronic devices they carry, may be searched for

a) travel and identity documents;

b) weapons or dangerous objects not permitted in the Centre;

c) narcotics and other substances according to Article 2 of the Narcotics Act of 3 October 1951 (BetmG);

d) assets of dubious origin.

2 The search must be carried out with respect for human dignity.

3 The search must always be carried out by a member of the security staff with the presence of at least one other member of staff.

RCCP

To the extent possible, disturbances of order within the Centre must be resolved by applying mediation methods. In case of necessity, the re-establishment of order may be carried out by security personnel, including those belonging to an emergency response agency. Only in exceptional circumstances may personnel attempt to intervene in order to calm the beneficiaries.

RCCP

1 The use of physical force against beneficiaries is prohibited, except by security personnel in the following cases and to the strictly necessary and proportional extent, namely

a) to prevent acts of violence against themselves, third parties or property;

b) to overcome resistance to the execution of orders given by security or police personnel.

2 Members of the security personnel who have had to use physical force are obliged to report it immediately to the Director.

3 Members of the security personnel who use physical force are responsible for their actions and any criminal consequences. The provisions of the Law on the civil liability of public bodies and public agents of 24 October 1988 remain reserved.

RCCP

1. No coercive measures may be used against beneficiaries, except for the purpose of preventing harm to persons or property, ensuring the safety of a beneficiary, staff, or for security measures.

2. The use of coercive measures must be limited to the strictly necessary time and, where possible, monitored by healthcare personnel.

3. Anyone who has had to use coercive measures is obliged to immediately report and inform the Director.

4. Members of security personnel who employ coercive measures are responsible for their actions and any criminal consequences. The provisions of the law on the civil liability of public bodies and public agents of 24 October 1988 remain reserved.

RCCP

1 To avert a serious, immediate, and otherwise unavoidable danger, the beneficiary may be temporarily detained within the Centre, in a specially equipped, supervised, and locked room, if

a) the foreseen detention is proportionate, and

b) the beneficiary

1. seriously endangers other persons;

2. seriously endangers themselves, or;

3. threatens to cause serious material damage.

2 In the event of a short-term detention, the competent police authorities, and if necessary other responsible bodies, must be informed. The beneficiary may be detained until the arrival of the competent police authority or another responsible body. If the competent police authority or another responsible body does not arrive within two hours, the short-term detention must be interrupted.

3 At the beginning of the short-term detention, the beneficiary shall be searched, and all dangerous objects shall be confiscated from them. The well-being of the beneficiary must be monitored throughout the duration of the short-term detention.

4 A short-term detention order against children and minors who have not yet reached the age of 15 is excluded.

5 Security personnel members who, on their own initiative, decide to deprive a beneficiary of their liberty are responsible for their actions and any criminal consequences. The provisions of the Law on the Civil Liability of Public Bodies and Public Agents of 24 October 1988 remain reserved.

RCCP

1 The beneficiary is, in principle, autonomous in managing their own health.

2 The Centre provides a healthcare service for the distribution of medicines if the beneficiary is unable to manage their medical treatments. The beneficiary may, during designated times, seek medical advice from the healthcare service. Should nursing or medical staff not be present, the beneficiary is required, in case of urgency, to call for first aid intervention at 144. In case of need, the beneficiary can rely on the staff present at the Centre.

3 If a medical or specialist visit is necessary, the beneficiary refers to the healthcare service or staff. Agreed dates and times for appointments are binding and must be respected; except for emergencies, in case of non-compliance, the invoice may be charged to the beneficiary.

4 Upon request, the beneficiary may be accompanied by a member of the Centre's staff or by an external entity. The Centre is not obliged to provide staff if the situation does not permit it or if it does not deem it necessary.

5 During their stay at the Centre, the beneficiary is insured according to the Federal Law on Health Insurance of 18 March 1994 (LAMal).

RCCP

1 The beneficiary may keep among their personal belongings over-the-counter medications and list A and B medications if prescribed by a doctor. The beneficiary is solely responsible for the medications they possess and their use.

2 In case of need, the beneficiary may request assistance from the Centre's healthcare staff for the administration of their medications. The healthcare staff, in collaboration with the staff and the attending physician, may decide to manage the therapy for a beneficiary if they deem it necessary.

3 The Centre maintains an "in-house pharmacy" which is made available to beneficiaries upon request to the Centre's staff. The Centre disclaims all responsibility in case of improper use of such medications.

RCCP

1 The Centre organizes activities to enhance the beneficiary's integration pathway. These must not conflict with the activities and measures provided for by the social, linguistic, and professional integration strategy implemented by the Department of Health and Social Affairs. The beneficiary is required to participate in these activities within the limits of their physical and health capabilities.

2 The Centre organizes voluntary recreational activities.

RCCP

1 The activities are organized weekly and assigned, according to the planning criteria developed by the staff, in collaboration with the entity responsible for integration.

2 Each beneficiary may be assigned to a group based on objective criteria that reflect the person's level of integration, their professional and linguistic knowledge, and their personal capacities.

3 Each beneficiary is required to regularly check the information board to be aware of the activities in which they must participate.

RCCP

If a beneficiary participates in all or a part of the activities proposed by the Centre, they are required to attend or justify their absence promptly. The Director may impose sanctions in the event of unjustified absence as provided in Article 52.

RCCP

1 Each month, staff calculate the amount of remuneration to be paid to the beneficiary.

2 A maximum of CHF 200.– per family unit may be withheld from the living allowance as security for potential damages. Any available balance will be returned upon the beneficiary's departure.

RCCP

1. Expenses directly related to the performance of activities proposed by the Centre are borne by the latter.

2. For travel for private purposes, each beneficiary must independently obtain a valid transport ticket. To the extent that a beneficiary fails to comply with this provision and is therefore fined by the relevant transport company, the amount of the fine shall be entirely borne by the beneficiary. For the payment of the fine, depending on the case and circumstances, the Centre may opt (with the beneficiary's consent) for a deduction from the sustenance allowance or from the contribution for the execution of employment programmes, as well as any other means useful for recovering the amount of the fine.

RCCP

1. The beneficiary who engages in a gainful activity is, within the limits of their employment percentage, fully or partially exempt from the obligation to participate as set forth in Article 37, as well as for the cleaning and maintenance work specified in Article 19.

2. The beneficiary who engages in a gainful activity must declare it to the competent authority and inform the personnel at the moment the contract is stipulated; a copy thereof must be promptly delivered to the personnel.

RCCP

1. A beneficiary who is undergoing training must inform the staff when their participation in it is confirmed. The beneficiary is wholly or partially exempt from the obligation to participate as set out in Article 37, as well as from maintenance work referred to in Article 19.

2. A beneficiary who is enrolled in training must promptly provide the staff with a copy of the enrollment confirmation.

RCCP

The activities proposed by the Center may be organized and carried out in collaboration with partners external to the facility. In such case, the beneficiary undertakes to comply with the directives of the partners.

RCCP

To make known the customs and traditions of the Canton, as well as its territory, the Centre organizes recreational activities in which the beneficiary may participate.

RCCP

1 Every beneficiary must be encouraged and helped to maintain or establish relationships with the outside world, as well as to interact with the territory.

2 Necessary restrictions are reserved in the interest of the security and discipline of the Accommodation Centre and those that are ordered by the Director.

RCCP

1 Beneficiaries have the right to receive visits according to the procedures and within the terms provided by this article. Visits are permitted between 9:00 AM and 9:00 PM. Access for visitors may be limited to specific premises or structures designated for this purpose. The Director may grant exceptions.

2 Visits must be announced with at least 24 hours' notice, using the appropriate form. The Director may grant derogations.

3 In the event of failure to sign the entry protocol, access will not be authorized.

4 The Director may deny access to the Centre to visitors who disturb or alter the peace and/or security of the beneficiaries.

RCCP

1 Beneficiaries are entitled to be absent from the facility for a maximum of 30 days per year.

2 Leave may not exceed 7 consecutive days, and in any case, the beneficiary must submit a request to the staff at least 48 hours in advance using the appropriate form. In specific circumstances, permits must be issued in collaboration with the competent authorities.

3 The actual duration may be limited if the circumstances of the case so justify. During the absence from the Centre, financial support is reduced according to the provisions in force at URAR. In case of absence, keys must be deposited at the Centre's reception. The beneficiary must always indicate where they are going and leave contact details where they can be reached.

RCCP

1 The beneficiary who does not return to the Center and is without a leave permit is considered to be unjustifiably absent. An unjustified absence may result in the immediate reduction of welfare benefits.

2 If the absence extends beyond 72 hours, staff will report the disappearance to the competent authorities and the bed may be reassigned. The beneficiary's belongings are stored and kept for a maximum of 3 months. In the event of reappearance and in the absence of a suitable justification, the beneficiary will be required to compensate the Center for storage and any disposal costs. A night is calculated from noon to noon of the following day.

3 In the event of reappearance, staff will direct the missing beneficiary to URAR for reassignment.

RCCP

All persons entering the Centre must comply with the current provisions, specifically

a) must be authorised by the Director, with the exception of representatives of judicial authorities and supervisory commissions recognised by the Confederation and/or the Canton;

b) must complete and sign an access protocol;
