§ 67 Ordinance on Legal Status (RSV) - Working Time Balance for Annual Working Hours
§ 67 RSV - Working Time Balance for Annual Working Hours — Working Time Balance for Annual Working Hours
**1. The Working Time Balance During the Calendar Year**
The working time balance for full-time employees must not exceed plus 200 hours or minus 100 hours during the calendar year. The compensation of a positive working time balance must be discussed with the supervisor; it may be mandated for operational reasons.
**2. Carryover Working Time Balance to the Following Calendar Year**
The working time balance, when carried over to the following calendar year, must not exceed plus 42 hours or minus 20 hours for full-time employees. The heads of the departments, the state chancellery, the offices, institutions, and courts may defer the timing of this carryover by up to six months, and in justified exceptional cases, by up to one year for operational reasons.
**3. Time Credit Exceeding the Limit**
Time credits that exceed the maximum limit at the end of the deferral period shall expire. However, the heads of the departments, the state chancellery, the offices, institutions, and courts may grant compensation for part of the working time balance exceeding 42 hours in justified exceptional cases with the approval of the personnel office.
**4. Balancing Positive or Negative Working Time Balance**
A positive or negative working time balance must be adjusted before leaving the service. A positive balance may be financially compensated if a reduction cannot occur for operational or compelling personal reasons before leaving. A negative working time balance is generally offset against the salary.
