Ordinance of the Governing Council on the Implementation of Federal Legislation on Identity Documents for Swiss Nationals - Scope

1. This regulation governs the execution of the Federal Act on Identification Documents for Swiss Nationals (Identification Act, AwG), the Ordinance of the Federal Council on Identification Documents for Swiss Nationals (Identification Ordinance, VAwG), and the Ordinance of the Federal Council on the Introduction of the Passport 2010.

1. The enforcement of federal legislation regarding identity documents for Swiss nationals is the responsibility of the cantonal identification authority and, within the scope of § 3, the municipal resident registration offices under the supervision of the Department of Justice and Security.

1. The residents' registration office of the municipality of residence is the applying authority for pure identity card orders without a data chip.

1. The issuing authority is the cantonal identification office.

1. Competent Police Authority within the Meaning of Art. 12 para. 2 lit. d and lit. e AwG is the Police Command.

1. The law enforcement and correctional authorities, the courts, the guardianship authorities, and the authorities responsible for the acquisition and loss of cantonal and municipal citizenship rights shall submit the notifications specified in Art. 13 para. 1 AwG to the cantonal identity document office.

1. Anyone who wishes to apply for an identification card with the issuing authority must, as a general rule, transmit their personal data via the internet or telephone before appearing in person.

2. The digital photograph will be captured by the issuing authority. Photographs brought by the applicant will not be used.

1. The fees for issuing identification documents and for further services pursuant to Art. 46 VAwG are determined according to Annex 2 of the VAwG.

2. The fees for expenses pursuant to Art. 49 VAwG are determined according to the fee regulations of the authority providing the services.

3. In the case of an in-person appearance without a prior application for issuance according to § 7 para. 1, a surcharge of Fr. 20 per application is imposed according to Art. 46 para. 2 lit. a VAwG.

1. The revenue from fees for the issuance of passports, combined offers for passports and identity cards at a special price, and provisional passports according to Annex 3 of the Administrative Act on Travel Documents (VAwG) shall accrue to the canton.

2. Of the revenue from fees for individual identity cards without a data chip according to Annex 3 of the VAwG, 60% shall accrue to the canton and 40% to the municipalities.

3. The fees for additional services or expenses as per Articles 46 and 49 of the VAwG shall accrue to the authority providing the service.

1. The fees for the identification documents shall be paid to the applying authority in the case of § 3, and to the issuing authority in other cases.

2. The fees for additional services and expenses pursuant to Articles 46 and 49 of the Administrative Fees Act shall be paid to the service-providing authority.

1. The canton settles accounts monthly with the applying authorities.

1. The Ordinance of the Government Council concerning the Implementation of the Federal Legislation on Identity Documents for Swiss Nationals dated December 17, 2002, is repealed.

1. This regulation shall enter into force on March 1, 2010.
