Statutory Text (40 Provisions)
1 This Ordinance regulates the fees for the administration of the Canton, the
districts and the municipalities and for the administration of justice, unless otherwise regulated by federal law, state treaties or special enactments of the Canton and, within the scope of their autonomy, of the districts and municipalities.
2 The Government Council shall issue a schedule of fees.
1. Use, administration, and court fees may only be levied
insofar as they are provided for in this Ordinance or in another legal enactment or
in the fee schedule.
2. For official acts for which no special fees are designated in the following provisions and in
other enactments, a fee of CHF 30 to CHF 5,000 may be levied.
1 Administrative and court fees, as well as indemnities, are to be determined in accordance with the statutory rates, subject to paragraph 3.
2 If a minimum and maximum rate exists, the fee for the individual case is to be determined according to the significance of the matter and the time spent. For the calculation of time spent, a rate of CHF 180.-- per hour may not be exceeded.
3 The maximum rate may exceptionally be exceeded by up to 50 percent if an official act requires such a substantial effort that the maximum rate is in obvious disproportion to it.
4 Fees and expenses for appeal proceedings may be determined as a lump sum.
1. Disbursements and remunerations are to be added to the fees, with the exception of office fees, which may be included in the fee.
2. Any value added taxes will be added to the fee rates.
1 The fee shall be borne by whoever claims the public matter or institution or has
initiated an official act.
2 Fees for procedural orders may be imposed with the order itself
or with the decision.
3 If several persons are liable for a fee, they shall be jointly and severally liable
in the absence of other provisions.
1. Usage fees shall accrue to the state, district, or municipal treasury.
2. Administrative fees of cantonal authorities and offices shall accrue to the
state treasury.
3. Administrative fees of authorities and offices of districts and municipalities
shall accrue to the district or municipal treasury, unless the districts and
municipalities have made a different arrangement.
4. Court fees shall accrue to the court treasury; paragraph 3 shall apply mutatis
mutandis.
5. Fees, if they do not exceed CHF 1000, may be collected by cash on delivery.
1 The fees, remunerations and disbursements shall be noted on the copies,
unless a separate invoice is issued.
2 The fee payer may request an appealable cost order with a detailed statement
of account within 20 days of the invoice being served.
3 The competent authority or office shall issue an appealable cost order ex
officio if the invoice is not paid and no enforcement title yet exists.
1. The statement of costs is generally challengeable with the main action.
