§ 76ter Act on Judicial Protection in Administrative Matters (Verwaltungsrechtspflegegesetz) - 2. Advance

1. An advance payment may be required for evidentiary measures. If it is not provided, the measures are to be carried out only insofar as the public interest necessitates it.

2. The complaining or suing party may be required to make an advance payment up to the estimated court costs, under the threat of dismissal if not complied with. If the payment is not made within the set deadline, the court will not proceed with the complaint or lawsuit.
