Art. 26 Intercantonal Agreement on Public Procurement (IVöB) - Conditions of Participation

1. The contracting authority ensures, within the framework of the procurement procedure and during the performance of the awarded services, that the provider and its subcontractors meet the eligibility criteria, notably the conditions set forth in Art. 12, have paid the due taxes and social security contributions, and refrain from collusive tendering agreements.

2. The contracting authority may require the provider to demonstrate compliance with the eligibility criteria, particularly by means of a self-declaration or inclusion in a register.

3. The contracting authority specifies in the invitation to tender or in the tender documents the timing and specific evidence that are required to be submitted.
