Intercantonal Agreement on the Gägelhof-Bergli Road Undertaking - Purpose and Legal Nature

1. The Road Company Gägelhof-Bergli aims to expand, correct, and maintain the Gägelhof-Bergli road within the territory of the political municipalities of Schwellbrunn and St. Peterzell.

2. It is a joint venture pursuant to Article 201bis of the Municipal Law of the Canton of St. Gallen, with its seat in the political municipality of St. Peterzell.

1. The company is subject to the law of the canton of St. Gallen, insofar as this agreement does not stipulate otherwise.

1. The statutes regulate

a) Membership;

b) Distribution of costs;

c) Organization;

d) Rights and obligations of the members.

1. The company acquires legal personality upon the approval of the statutes by the competent authority of the political municipality of St. Peterzell.

1. The political municipality of St. Peterzell exercises supervision in agreement with the competent authorities of the Canton of Appenzell A. Rh.

1. The competent authorities of the Canton of St. Gallen assess public law disputes between the company and members.

2. Disputes between the contracting cantons are submitted to the Federal Supreme Court in accordance with Art. 113 para. 1 no. 2 of the Federal Constitution.

1. This Agreement shall be applied by the signatory cantons upon signing.
