Art. 78 Act on Administrative Procedure and Administrative Justice (Administrative Justice Act, VRG) (Verwaltungsrechtspflegegesetz, VRG) - New Decision by the Lower Instance

1. The lower instance cannot alter or revoke its decision during the appeal proceedings; however, the acknowledgment of legal claims remains permissible.

2. During the appeal proceedings, the party may not initiate a new procedure in the same matter, subject to paragraph 3.

3. If the party files a request for reconsideration according to Article 66 during the appeal proceedings, it must inform the appellate authority immediately; the appeal proceedings shall be suspended ex officio until the conclusion of the reconsideration proceedings.
