Art. 54 Act on Administrative Procedure and Administrative Justice (Administrative Justice Act, VRG) (Verwaltungsrechtspflegegesetz, VRG) - Prerequisites for Decision, Non-Admission

1. The authority shall ex officio examine whether the requirements for the issuance of a decision are met; it may initially limit the procedure and the decision to these issues.

2. The issuance of a decision particularly requires

1. Local and subject-matter jurisdiction;

2. Party and procedural capacity;

3. Authorization of representation by party representatives;

4. Existence of a particular concern and a legitimate interest in the decision;

5. Timely and proper legal measures.

3. If a requirement for the issuance of a decision is missing, the authority shall not proceed with the matter.
