Art. 38 Act on Administrative Procedure and Administrative Justice (Administrative Justice Act, VRG) (Verwaltungsrechtspflegegesetz, VRG) - Restoration

1. Restoration of a deadline or appointment may be granted if the applicant or their representative was unavoidably prevented from acting within the deadline, submits a substantiated request for restoration within ten days after the removal of the obstacle, and simultaneously completes the missed legal action.

2. The authority provides the opposing party with the opportunity to respond; it gathers the necessary evidence and renders a decision without further appeal.
