Art. 24 Administrative Procedure Act, APA - Precautionary Measures — Precautionary Measures

1. The authority may take precautionary measures to preserve the existing condition or to provisionally protect threatened legal interests.

2. In urgent cases, these measures may be taken by the chairman of the collegial authority or the designated body.

3. If proceedings on the merits have not yet been initiated, the authority shall set a deadline for the applicant party to file a complaint, with the warning that the ordered measure will lapse without further action if the deadline expires unused.

4. If circumstances change or if the precautionary measures subsequently prove to be unjustified, they may be amended or revoked.

5. Upon the final and binding decision on the merits, the measures lapse by operation of law. The authority may order their continuation if it serves the enforcement or if the law provides for it.
