Art. 117 Act on Administrative Procedure and Administrative Justice (Administrative Justice Act, VRG) (Verwaltungsrechtspflegegesetz, VRG)

1. In the initial administrative procedure and in the internal administrative appeal procedure, an advance payment of costs is to be made in accordance with Article 17 of the Fees Act.

2. In the administrative court and constitutional court procedures, the appellant or plaintiff party must provide an appropriate advance payment for the official costs. The opposing party may be required to make an advance payment if it appears warranted due to the evidentiary requests.

3. The procedural management determines the amount of the advance payment for costs.
