Implementing Ordinance on the Cantonal Geoinformation Act (Cantonal Geoinformation Ordinance, kGeoIV) - Third-Party Geodata (OCGeo)

1. Geodata of Third Parties of General Interest may be included in the Geoinformation System if

1. the geodetic reference frame of the national survey is used as the basis for the geodata;

2. the geodata is based on a platform-independent data model that complies with generally accepted standards (INTERLIS[2]); and

3. the data owner

a) provides assurance of adequate maintenance; and

b) commits to paying a one-time processing fee and annual maintenance fees according to the fee schedule for the use of the Geoinformation System (GIS Fee Schedule)[3].

1. The competent cantonal and municipal authorities as per the geodatabase catalogs in Annexes 1 and 2 are obligated to report their surveys and modifications of geodata to GIS Data Ltd. GIS Data Ltd., in conjunction with these authorities, establishes the technical and substantive requirements for the geodata.

2. Third parties are required to report any changes they have caused to the competent cantonal or municipal authority.

3. The data owners pursuant to § 1 are subject to the reporting obligation according to paragraph 1.

1. The modified data must meet the same qualitative requirements as the data upon entry into the geoinformation system.

2. The data must be reported within 20 days of becoming aware of their modification.

1. Catalogs of the Federal Geospatial Data (Classes II and III) according to Appendix 1, as well as of the Cantonal Law (Classes IV and V) according to Appendix 2, regulate

1. the authority responsible for data collection;

2. the types of access;

3. the levels of access authorization

a) public (A);

b) restricted public (B);

c) non-public (C);

4. the content assigned to the cadastre of public-law restrictions on landownership (ÖREB Cadastre).

2. The GIS Data AG decides on the access provision to the data based on the catalogs of the geospatial data.

1. The GIS Data Ltd., upon request, issues certified extracts from the geoinformation system, including the cadastre of public-law restrictions on land ownership (ÖREB cadastre).

2. The cadastral surveyor, upon request, issues certifications for the land register plan.

1. GIS Data Ltd is the entity responsible for the cadastre of public-law restrictions on landownership.

2. The competent cantonal and municipal authorities as per the geobase data catalogs in Annex 1 and 2 must report orders and changes to their public-law restrictions on landownership to GIS Data Ltd.

3. The company makes entries and changes in the cadastre of public-law restrictions on landownership only if there is sufficient legal title.

4. The cadastre of public-law restrictions on landownership is made accessible via a retrieval process.

1. The Directorate forwards the geographical names collected, updated, and managed by the authority responsible for official surveying to the Nomenclature Commission for the purpose of making a recommendation.

2. The Nomenclature Commission provides the political municipalities with the opportunity to comment on its recommendation. These municipalities may, within the scope of their comments, also consult the affected parties.

3. The Directorate decides after reviewing the recommendation of the Nomenclature Commission and the comments of the political municipalities. If it does not follow the recommendation of the Nomenclature Commission, it obtains the opinion of the Federal Surveying Directorate before making a decision.

1. The Cadastral Surveyor and the Land Registry Office shall support each other with respect to maintaining a complete, current, and accurate land register.
