Decision of the Cantonal Parliament on the Oath of Office and Solemn Promise - Taking the Oath of Office or the Manual Vow

1. The oath of office or the solemn promise must be taken by

1. the members of the cantonal council, the government council, the cantonal court, the higher court, and the administrative court;

2. the members of the administrative council of the municipalities;

3. the members of the conciliation authority;

4. the members of the child and adult protection authority;

5. the county clerk, the cantonal council secretary, as well as the court clerks;

6. the municipal clerks;

7. the chief public prosecutor, the public prosecutors, as well as the youth prosecutors;

8. the members of the police corps;

9. the other cantonal and municipal authorities and employees, insofar as they are obligated by legislation.

1. Oath of Office or Solemn Affirmation are to be administered

1. by the members of the authorities, the canton scribe, the district scribe, the court scribe, and the municipal scribe before the assembled authority;

2. by the cantonal employees before the Landammann or the member of the government council appointed by him;

3. by the municipal employees before the president of the administrative council, or the vice president or deputy.

2. The chairperson is required to read the formula for the Oath of Office or Solemn Affirmation.

3. The Oath of Office or Solemn Affirmation is then completed by declaring the words: "I swear it" or "I affirm it," respectively.

1. The Oath Formula is as follows

1. For members of the authorities: "I swear before Almighty God to faithfully uphold the constitution and laws of the Federation and the Canton, to stand for the unity and independence of the Fatherland, to protect the freedom and rights of the people and its citizens, to maintain the required confidentiality, and to fulfill all duties entrusted to me to the best of my knowledge and conscience, without regard to person and without consideration of personal advantages and disadvantages, so help me God";

2. For employees: "I swear before Almighty God to faithfully and conscientiously fulfill all the official duties imposed on me by the constitution, laws, and my superiors, without regard to person, to maintain the required confidentiality, and to promote public welfare to the best of my ability, so help me God."

1. The Oath of Office Formula is as follows

1. For members of the authorities: "I swear to faithfully uphold the Constitution and laws of the Confederation and the Canton, to stand for the unity and independence of the Fatherland, to protect the freedom and rights of the people and its citizens, to maintain the requisite confidentiality, and to fulfill all duties assigned to me to the best of my knowledge and ability, without regard to persons, and without consideration of personal advantages or disadvantages."

2. For employees: "I swear to faithfully and conscientiously perform all official duties imposed on me by the Constitution, the laws, and my superiors, without regard to persons, to maintain the requisite confidentiality, and to promote public welfare to the best of my ability."

1. Oath of Office and Hand Vow are not to be repeated in confirmation elections.

1. The Ordinance of 8 February 1964 on the Official Oath and Solemn Affirmation is repealed.

1. This resolution shall enter into force on November 1, 2012.
