Table of Provisions (18)
Statutory Text (18 Articles)
[2] 1 The Department of Health, Youth, and Sports (hereinafter: the department) is responsible for the implementation of the law.
2. The Statistics Service (hereinafter: the service) is the executing body of the department.
The service has the following missions, among others
a) to provide the cantonal and communal authorities and the community with relevant, meaningful, reliable, and coherent statistical information;
b) to collect, produce, process, analyze, and store data for statistical purposes based on scientifically chosen principles, independently and in compliance with data protection rules and the Swiss public statistics charter;
c) to contribute to the development of the Swiss statistical information system by collaborating with the Confederation, other cantons, communes, and various partners.
The service is responsible for conducting investigations at the request of the Council of State.
1. The service acts as a liaison for the Federal Statistical Office in the context of federal surveys, including the structural survey and thematic surveys related to the federal population census.
2. It is the designated correspondent for the cantonal administration regarding the exchange of data for statistical purposes with the Confederation and other cantons.
1. Any person engaged in an activity within the service is considered as duly authorized to process and exploit data within the meaning of the LStat.
2. These persons are required to respect statistical confidentiality in accordance with Article 7 LStat, the cantonal regulations relating to data protection, as well as the charter of Swiss public statistics.
1 In accordance with Article 19, paragraph 2 of the Statistical Law, the minimum number of statistical units required for the publication or transmission of statistical data is, subject to paragraph 2, three units.
2. When it concerns data that are not sensitive or do not allow any inference about the situation of a natural or legal person, this minimum number may be waived.
[3] Statistical data may be published or transmitted without restriction when they relate to an official geographical area (municipality, district, street, etc.) and any other geographical segmentation, provided that article 19, paragraph 2 LStat is respected.
1. Statistical data that result from enumerations, without indication of additional statistical characteristics, may be transmitted by address, or even by dwelling.
2. The transmission of such data is permissible provided they are used for research, planning, or statistical purposes. This is done upon a duly motivated written request.
3. The transmission of the requested data requires a written commitment from the requestor to comply with all cantonal provisions regarding statistical confidentiality and may require the communication to the service of the results of the work based on the transmitted data.
When it involves individual data, transmission to third parties is carried out, in compliance with Articles 53 or 54 of the inter-cantonal convention of May 8 and 9, 2012, concerning data protection and transparency in the cantons of Jura and Neuchâtel (CPDT-JUNE) [4], upon a duly motivated written request to the service. It is subject to a written contract that prohibits any use other than the one specified, which particularly binds the requester not to transmit them to third parties, to take organizational and technical measures to ensure their protection, to delete them after use, to comply with cantonal provisions on statistical confidentiality, and which may require the transmission of results based on the transmitted data to the service.
The following three groups are considered services within the meaning of this regulation
c) on-demand work and special operations.
1. Basic statistical results are considered to be all data directly available to the service without any special work provided by the service. They are, in principle, provided free of charge and include, in particular
a) responses to current and brief statistical information requests;
b) access to the documentation center and consultation of all public documents within the service or via the service's website.
2. In the case of requests whose repetition generates a significant workload, the service may charge for its services, in accordance with Article 13, paragraph 3.
Standard services and products are subject to charges and include, in particular, publications, reports, maps, charts, standard tables, etc. The rates and prices for services and products are determined by the department.
1 Services provided upon request and special operations are chargeable if their execution requires half an hour of work or more; in this case, billing also applies to the first half-hour. These services include, in particular
d) administrative work related to the service.
2 Upon request from the interested party, the department provides an estimate before commencing the work.
3 Chargeable services are billed at an hourly rate of 150 francs, excluding VAT, for work as referred to in letters a to c of paragraph 1 and 90 francs, excluding VAT, for work as referred to in letter d of paragraph 1.
1. The service may charge the following disbursements
f) travel and transportation expenses.
2. The disbursements correspond to the actual costs incurred.
When the same user repeatedly requests services within the meaning of Articles 13 and 14, the service may set subscription fees instead of billing them individually.
The service may decide on a reduction of the billed amount or an exemption from billing when the services provided are used for public benefit or scientific purposes.
The department is responsible for the implementation of this regulation.
1. This regulation shall enter into force on July 1, 2016.
2. It shall be published in the Official Gazette and inserted into the Neuchâtel Legislative Compendium.
