1 This agreement contains the provisions governing, in the field of music schools, the financial, administrative, and legal issues related to the transfer of the municipal commune of Moutier (hereinafter: "the commune of Moutier") into the Republic and Canton of Jura (hereinafter: "the canton of Jura").

2 It specifically regulates the legal framework applicable to the offerings of the Music School of the Bernese Jura and its financing.

1 "Transitional phase" refers to the period from January 1, 2026, to July 31, 2026.

2 "Subsidized Prévôtois students" refers to children, adolescents, and young adults as defined by Article 9 of the Bernese Law of June 8, 2011, on music schools who have their civil domicile in the municipality of Moutier on the date of the transfer of the municipality of Moutier to the canton of Jura (hereinafter: "the date of the transfer").

1 The municipality of Moutier transitions from the Bernese legal order to the Jurassian legal order as of the date of transfer in accordance with Article 3 of the concordat on the transfer of Moutier, with the exception, during the transitional phase, of the provision regarding the Bernese Jura School of Music and its funding.

2 The Bernese Jura School of Music provides music lessons to Prévôt students subsidized during the transitional phase.

The subsidized students from Prévôtois who, at the date of the transfer, are attending the École de musique du Jura bernois, may complete the 2025-2026 school year at that school.

1 During the transitional phase, the cantonal portion of funding for the Jura Bernese School of Music related to subsidized students from the town of Moutier is the responsibility of the Canton of Jura.

2 With the exception of premises, which remain the responsibility of the municipality of Moutier, the municipal portion of funding for the Jura Bernese School of Music related to subsidized students from the town of Moutier is the responsibility of the Canton of Jura during the transitional phase. The municipal portion is governed by the service contract between the Jura Bernese School of Music Association and the Jura Bernese-Bienne Association.

3 The accounts between the Jura Bernese School of Music and the Canton of Jura must be settled by November 30, 2026, at the latest.

This agreement enters into force on January 1, 2026.
