Principles

1 Violations of cantonal law are, according to this Ordinance, punished with a fine under a simplified procedure (summary fine procedure), provided they are listed in Articles 12–16.

2 The fine amounts are determined according to Articles 12–16; previous record and personal circumstances of the accused person are generally not taken into account.

Applicability

1 The summary fine procedure is applicable when the competent police or control authority has ascertained the contravention and the facts are clear both legally and factually.

2 The summary fine procedure is not applicable if

a. the accused person has endangered or injured someone or caused significant property damage;

b. the accused person is accused of a contravention that, in the specific case, is obviously no longer minor;

c. the accused person rejects the summary fine procedure for the contravention or for a part of the contraventions they are accused of.

3 If only a minor oversight exists, the competent police or control authority may refrain from issuing a summary fine.

Youth Loans

1 For young people between the completed 10th and the completed 15th

year of age, the competent police or control authority draws attention to the transgression. It can invite the young person, especially in the areas of nature and environmental protection as well as fishing, to attend classes on a specific day or to make amends for the damage.

2 If the young person does not follow the invitation, the competent police or control authority reports the matter to the youth public prosecutor's office.

3 The summary fine procedure is not applicable if the offense is committed by a young person under ten years of age. Furthermore, the conditions for the applicability of the summary fine procedure for young people, as stated in Article 2, apply mutatis mutandis.

2. Procedure

Competition

1 If the accused person, through one or more simultaneous acts, fulfills several minor offense definitions at the same time, the amounts shall be added together and a single total fine shall be imposed.

2 If the total fine exceeds 1000 francs, the offenses shall be judged in ordinary criminal proceedings.

2. Die Bussen dürfen nur vor Ort erhoben werden, wenn die Polizei- und Kontrollorgane die Widerhandlung in amtlicher Funktion festgestellt haben. Die Polizei- und Kontrollorgane haben sich auszuweisen.

Procedure

1 If the accused person is identified at the time of the violation, they may pay the fine immediately or within 30 days.

2 In the case of immediate payment, a receipt will be issued which specifies, among other things, the place, date, time, and type of infraction, but not the personal details.

3 If immediate payment is not made, the accused person will receive a reflection period form with a payment slip, in which their personal details are also recorded.

4 If the accused person is not identified at the time of the violation or does not pay the fine within the deadline, ordinary criminal proceedings will be initiated.

Costs

1 No costs are levied in the summary penalty procedure.

Res Judicata

1 The fine becomes legally binding upon payment. Recorded personal data will be destroyed.

Accused Persons Without Residence in Switzerland

1 Anyone who does not have a residence in Switzerland and does not imme-

diately pay the fine must deposit the amount or provide an adequate security.

Rejection of the Fixed Penalty Procedure

1 The competent police and control bodies are obliged to inform the accused

person that they may refuse the fixed penalty procedure.

2 If the accused person refuses the fixed penalty procedure, ordinary criminal

proceedings will be initiated.

Enforcement

1 The Cantonal Police are responsible for the administrative enforcement of the summary fine procedure. To this end, they may issue directly binding instructions to other police and control bodies authorized to levy fines.
