**2. Fees**

Kanton Glarus

Principle

1 The Land Register Administrator and the Municipal Clerks, as well as their deputies, shall charge the fees stipulated in the Schedule of Fees (Appendix) for their authentication activities.

2 Lawyers shall charge a fee in accordance with Article A1-4 of the Appendix for their official acts under Article 5 of the Act.

3 Notary Publics may, in addition, claim reimbursement for necessary expenses, such as postage, telephone charges, travel expenses, translation costs, etc., and for the value-added tax to be paid by them on the fee and expenses, to the extent that VAT liability exists.

Kanton Glarus

Scope of Application

1 The fee as remuneration for the notarisation activities of state employees

includes the preparatory work (familiarisation with the matter, identifi-

cation of parties, ascertainment of the parties' intent), the drafting of the instrument,

the actual notarisation act, the registration and safekeeping of the

original, the creation and issuance of an official copy for the parties

and public registers, as well as dispatch to the parties or the

registration of legal transactions requiring entry.

4

III B/3/2

2 Further expenses incurred by state-employed notarial officers in connection with

the notarisation business, such as the drafting of contract proposals, special

clarifications, specific research, and the engagement of the notarial officer outside

of usual business hours or outside the office, may be separately invoiced.

3 The official act pursuant to Article 10 Paragraph 2 includes the identification

of parties, the ascertainment of the parties' intent, the review of a submitted

draft, as well as the actual notarisation act and the registration of legal

transactions requiring entry. Compensation for other expenses, such as

for drafting or preparing the instrument or further legal advice, etc., must be agreed upon.

4 The fees for certifications (A1.2. Appendix) apply to all notarial officers.

Kanton Glarus

### Assessment

1 The fee is assessed according to fixed rates, according to the value, or according to a fee schedule.

2 If the value is decisive, the fee is determined by the fractions or per mille values set forth in the Annex.

3 Where the ordinance establishes a fee schedule, the significance and complexity of the matter, the workload, and the duration of the services rendered are decisive for calculating the fee.

4 Disputes are decided by the Lawyers' Commission.

Kanton Glarus

Billing

¹ The notary shall inform the client, when taking on the matter, about the

expected fees and shall bill after the completion of the matter.

² Individually itemized shall be

b. the disbursements;

c. the value-added tax.

³ Unless otherwise agreed with the notary, multiple parties are jointly and

severally liable for the fees.

Kanton Glarus

Reduction of the Fee

1 The fee shall be reasonably reduced,

a.

if the public authentications requires little effort

or does not come to completion;

b.

if an authenticating officer has to authenticate numerous similar legal transactions in the same factual context.

5

III B/3/2

Kanton Glarus

Several Legal Transactions

1. When several legal transactions are notarized in the same document, the fee is calculated separately for each legal transaction, unless this regulation provides for a different rule. However, a separate calculation does not occur with the simultaneous notarization of legal transactions that do not require notarization, such as the establishment of limited real rights in a real estate purchase agreement.

Kanton Glarus

Fee Calculation Without Specific Fee Item, Fee Framework

¹ If no fees are provided for the establishment and notarization of a transaction in this Ordinance, the fees shall be determined according to the significance and difficulty of the transaction, as well as the workload and time spent by the notary.

Kanton Glarus

Securing Costs

1. To secure the prospective fees and cash disbursements, an advance on costs may be demanded.

Kanton Glarus

Remission

1. Fees and disbursements may be wholly or partially remitted where special circumstances justify it, particularly if the fee-payer is in financial hardship or if payment of the fee would cause him undue hardship.

Kanton Glarus

Preliminary Contract

1 The fee for the notarization of a preliminary contract is determined by the

respective fee for the main contract. If the main contract is notarized by the same notary, the fee for the main contract shall be half.

Kanton Glarus

Extension of a Fixed-Term Contract

¹ The fee for the extension of a fixed-term contract is one-third of that of the original contract.
