Organization

1 The Presidium presides over the entire authority within the meaning of Article 14, paragraph 1 of the GOG.

2 A court clerk participates in the meetings of the entire authority with an advisory vote and keeps the minutes.

Convocation

1 The Plenary Authority is convened by the Presidium and holds meetings as often

as business requires.

2 Four members of the Plenary Authority may request its convocation.

### Decision-Making

1 The collective authority is quorate if at least six members participate.

2 The collective authority decides by a majority vote of all participating members.

3 In the event of a tie, the motion for which the Presidium has voted shall be deemed adopted.

4 A decision by circular resolution is valid if all members have approved the resolution.

### 2. Management

Organization

1 The management of the High Court is the responsibility of the Presidency (Art. 16

para. 1 lit. b GOG), and in its absence, the part-time Vice-Presidency.

Tasks

1 The Management Board ensures the smooth running of business; it shall,

in particular

a. issue internal directives;

b. approve the forms used and the uniform design of decisions;

c. ensure a consistent practice of the High Court, if necessary involving the

entire authority in accordance with Article 15 paragraph 2 letter b GOG;

d. decide whether a decision will be published in a public case law database;

e. supervise the personnel assigned to the High Court;

f. represent the High Court externally;

g. approve expenditures (including attendance fees);

h. monitor the pending cases of the High Court.

2 The Management Board may delegate individual tasks to the part-time Vice-Presidency

or other members.

3. Distribution of Business and Panels

Distribution of Business

1. The Presiding Chamber is responsible for a balanced distribution of business between the Presiding Chamber and the semi-official Vice-Presiding Chamber; in justified cases, the Presiding Chamber may transfer a matter to an auxiliary Vice-Presiding Chamber or a member of the High Court. In doing so, it shall particularly consider the following criteria and circumstances

a. Balance of workload; the additional workload of the Presiding Chamber due to its function must be taken into account;

b. Involvement of members of both sexes in cases where the nature of the dispute makes it seem appropriate;

c. Specific expertise in a particular area;

d. Participation in previous decisions in the same subject area or in related proceedings;

e. Absences, especially illness, holidays, etc.;

f. Urgency of the matter;

g. Language skills;

h. Avoidance of foreseeable grounds for recusal.

1. Das Kollegialgericht tagt in der Besetzung mit dem Vorsitz gemäss Artikel 6 sowie der Anzahl Mitglieder gemäss Artikel 17 GOG.

2. Die Besetzung des Spruchkörpers mit den Mitgliedern des Obergerichts erfolgt in der Regel gemäss der Reihenfolge der Falleingänge (Stichtag 1. Juli) und alternierend gemäss Amtsalter. Der Turnus beginnt jeweils mit den amtsältesten Mitgliedern des Obergerichts. Für die nachfolgenden Geschäftsarten wird jeweils ein eigener Turnus geführt

3. Kann dem ordentlichen Turnus gemäss Absatz 2 im Falle eines Ausstandsgrunds oder einer Verhinderung nicht gefolgt werden, so wird der Spruchkörper gemäss Reihenfolge des Amtsalters mit einem Mitglied des Obergerichts ergänzt. Die turnusgemässe Zusammensetzung der Spruchkörper der nachfolgenden Geschäfte bleibt davon unberührt.

4. Das Präsidium kann von der Geschäftszuteilung gemäss Absatz 2 und Absatz 3 abweichen, wenn dies die Kriterien und Umstände gemäss Artikel 6 erfordern.

Supervision of the Cantonal Court

1 The High Court convenes as a collective authority (Art. 3).

Business Recording

1 The office of the Superior Court records cases in the order of their receipt

and determines the court composition in accordance with the instructions of the Presidency.

4. Special Provisions

Personnel Management

1 In terms of personnel, the Presidency is the point of contact for all employees of the High Court.

2 The Presidency may delegate this task to the part-time Vice-Presidency.
