Contracting Authority
¹ Within the scope of the state treaty, this agreement applies to state authorities as well as central and decentralized administrative units, including public law institutions at the cantonal, district, and municipal levels, as defined by cantonal and communal law, with the exception of their commercial activities.
² Within the scope of the state treaty, this agreement also applies to state authorities as well as public and private enterprises that provide public services and that are endowed with exclusive or special rights, insofar as they carry out activities in one of the following sectors in Switzerland
a. Providing or operating fixed networks for supplying the public in connection with the production, transport, or distribution of drinking water, or supplying these networks with drinking water;
b. Providing or operating fixed networks for supplying the public in connection with the production, transmission, or distribution of electrical energy, or supplying these networks with electrical energy;
c. Operating networks for supplying the public in the field of transport by light rail, automatic systems, tram, trolleybus, bus, or cable car;
d. Providing air transport undertakings with airports or other terminal facilities;
e. Providing inland waterway transport undertakings with ports or other terminal facilities;
f. Providing or operating railways, including the transport carried out thereon;
g. Providing or operating fixed networks for supplying the public in connection with the production, transport, or distribution of gas or heat, or supplying these networks with gas or heat; or
h. Exploiting a geographically defined area for the purpose of prospecting for or extracting oil, gas, coal, or other solid fuels.
³ The contracting authorities according to paragraph 2 are subject to this agreement only for procurements related to the described area of activity, but not for their other activities.
3
II G/1/2/1
⁴ Outside the scope of the state treaty, this agreement furthermore applies to
a. other bodies responsible for cantonal and communal tasks, with the exception of their commercial activities;
b. objects and services that are subsidized with public funds by more than 50 percent of the total costs.
⁵ If a third party conducts the award of a public contract for one or more contracting authorities, this third party is subject to this agreement as if it were the contracting authority it represents.
Applicable Law
1 If several contracting authorities subject to federal law and this agreement
participate in a procurement, the law of the Gemeinwesen
whose contracting authority bears the largest share of the financing
is applicable. If the total cantonal share exceeds the federal share, then
this agreement shall apply.
2 If several contracting authorities subject to this agreement participate in
a procurement, the law of the canton that bears the largest
share of the financing is applicable.
3 Several contracting authorities participating in a procurement are entitled,
by mutual agreement, to subject a joint procurement, in derogation
from the foregoing principles, to the law of a participating contracting
authority.
4 A procurement whose execution does not take place within the legal territory
of the contracting authority is subject, at the option of the contracting
authority, to the law at its seat or at the place where the services are
mainly provided.
5 A procurement by a joint entity is subject to the
law at the seat of the entity. If the entity has no seat, the law of the
place where the services are mainly provided shall apply.
6 Public or private undertakings with exclusive or special rights granted
to them by the Confederation, or which perform tasks in the national
interest, may choose whether to subject their procurements to the law
at their seat or to federal law.
Providers
1 Under this agreement, providers from Switzerland are admitted to tender, as are
providers from states with which Switzerland has a contractual obligation
to grant market access, the latter within the framework of mutually
assumed obligations.
2 Outside the scope of international treaties, foreign providers from
states are admitted to tender insofar as they grant reciprocity or
insofar as the contracting authority permits this.
II G/1/2/1
3 The Federal Council maintains a list of states that have committed to
Switzerland to grant market access. The list is periodically updated.
4 The Cantons may conclude agreements with bordering regions and neighbouring
states.
Exemption from Subordination
1 If there is effective competition in a sector market according to Article 4
paragraph 2, the Intercantonal Body for Public Procurement (InöB) may
propose to the Federal Council to exempt the corresponding procurements,
entirely or partially, from subordination to this agreement. Contracting
authorities active in the affected sector market are entitled to submit a
corresponding request to the InöB.
2 An exemption applies to the corresponding procurements of all contracting
authorities active in the affected sector market.
2.2. Objective Scope
Public Contract
1 A public contract is an agreement concluded between a contracting authority and a tenderer, serving the fulfillment of a public task. It is characterized by its remunerative nature and the exchange of performance and consideration, whereby the characteristic performance is rendered by the tenderer.
2 The following types of performance are distinguished
a. Construction works (main construction and ancillary construction trades);
b. Supplies;
c. Services.
3 Mixed contracts consist of different types of performance according to paragraph 2 and form an overall transaction. The qualification of the overall transaction follows the financially predominant performance. Performances may not be mixed or bundled with the intent or effect of circumventing the provisions of this agreement.
Transfer of Public Tasks and Granting of Concessions
1 The transfer of a public task or the granting of a concession is considered a public contract if the provider thereby obtains exclusive or special rights that he exercises in the public interest, and for which he directly or indirectly receives remuneration or compensation. Specific provisions of federal law and cantonal law take precedence.
5
II G/1/2/1

entities do not provide these services in competition with private
providers;
c. from dependent organisational units of the contracting authority;
d. from providers over which the contracting authority exercises
control equivalent to the control it exercises over its own departments,
insofar as these undertakings essentially provide their services to the
contracting authority.

of external or internal security or public order;

Recusal
1 In the procurement process, no persons may participate on the part of the client or an expert committee who
a. have a personal interest in a contract;
b. are connected with a tenderer or with a member of one of its bodies through marriage or registered partnership, or are living in a de facto cohabitation;
c. are related by blood or marriage in a direct line or up to the third degree in the collateral line to a tenderer or to a member of one of its bodies;
d. are representatives of a tenderer or have worked for a tenderer in the same matter; or
e. lack the independence required for the conduct of public procurements due to other circumstances.
2 A request for recusal must be submitted immediately upon knowledge of the ground for recusal.
3 The client or the expert committee shall decide on requests for recusal, excluding the person concerned.
4 The client may stipulate in the tender invitation that tenderers who are in a relationship justifying recusal with a jury member in competitions and study commissions shall be excluded from the procedure.
| | | | | | --- | --- | --- | --- | | a.
Determination of Contract Value
1 The contracting authority estimates the prospective contract value.
2 A public contract may not be split up in order to circumvent the provisions
of this agreement.
3 For the estimation of the contract value, the totality of the services or fees
to be tendered, insofar as they are closely connected factually or legally,
must be taken into account. All components of the fees are to be included,
including extension options and options for follow-up contracts, as well
as all expected premiums, fees, commissions, and interest, excluding value-added tax.
4 For contracts with a definite term, the contract value is calculated on the
basis of the accumulated fees over the definite term, including any
extension options. The definite term may generally not exceed five years.
In justified cases, a longer term may be provided for.
5 For contracts with an indefinite term, the contract value is calculated on
the basis of the monthly fee multiplied by 48.
6 For contracts for recurrently required services, the contract value is
calculated based on the fees paid for such services during the last twelve
months or, in the case of an initial award, based on the estimated demand
over the next twelve months.
**4. Award Procedure**
Threshold Values
1 The choice of procedure depends on whether a contract reaches a threshold value according to Annexes 1 and 2. The InöB periodically adjusts the threshold values after consultation with the Federal Council, in accordance with international obligations.
2 In the event of an adjustment to international obligations regarding threshold values, the Federation guarantees the cantons participation.
9
II G/1/2/1
3 If the total value of several construction services for the realization of a construction work reaches the threshold value of the state treaty area, then the provisions of this agreement for procurements within the state treaty area shall apply. However, if the values of the individual services do not reach two million Swiss francs and the aggregate value of these services does not exceed 20 percent of the total value of the construction work, then the provisions for procurements outside the state treaty area shall apply to these services (de minimis clause).
4 Outside the state treaty area, the applicable procedure for construction services is determined based on the value of the individual services.
Types of Procedures
1 Depending on the contract value and the thresholds, public contracts are awarded, at the contracting authority's discretion, either by open procedure, selective procedure, invited tender procedure, or negotiated procedure.
Open Procedure
1 In the open procedure, the contracting authority publicly advertises the contract.
2 All suppliers may submit a bid.
Selective Procedure
¹ In the selective procedure, the contracting authority publicly advertises the contract and invites tenderers to first submit an application to participate.
² The contracting authority selects the tenderers who may submit a bid based on their suitability.
³ The contracting authority may limit the number of tenderers admitted to submit a bid, as long as effective competition remains ensured. If possible, at least three tenderers will be admitted to submit a bid.
Invitation Procedure
¹ The invitation procedure applies to public contracts outside the scope of international treaties, in accordance with the threshold values set out in Annex 2.
² In the invitation procedure, the contracting authority determines which providers it wishes to invite to submit offers without public tender. For this purpose, it prepares tender documents. If possible, at least three offers are obtained.
10
II G/1/2/1
Direct Award Procedure
1 In a direct award procedure, the contracting authority awards a public contract directly without a tender process. The contracting authority is entitled to obtain comparative offers and to conduct negotiations.
2 The contracting authority may award a contract by direct award, irrespective of the threshold value, if one of the following conditions is met
a. no tenders or no requests to participate are received in an open procedure, a selective procedure, or an invitation procedure, no tender meets the essential requirements of the tender documentation or the technical specifications, or no tenderer meets the suitability criteria;
b. there are sufficient indications that all tenders received in an open procedure, a selective procedure, or an invitation procedure are based on an unlawful collusive arrangement;
c. due to the technical or artistic peculiarities of the contract or for reasons of protecting intellectual property, only one provider is suitable, and there is no reasonable alternative;
d. due to unforeseeable events, the procurement becomes so urgent that even with shortened deadlines, an open or selective procedure or an invitation procedure cannot be carried out;
e. a change of provider for services for the replacement, supplementation, or extension of already rendered services is not possible for economic or technical reasons, would cause significant difficulties, or would entail substantial additional costs;
f. the contracting authority procures initial productions (prototypes) or novel services that are manufactured or developed at its request within the scope of a research, experimental, study, or new development contract;
g. the contracting authority procures services on commodity exchanges;
h. the contracting authority can procure services within the framework of a favourable, time-limited opportunity at a price significantly below usual prices (especially in liquidation sales);
i. the contracting authority awards the follow-up contract to the winner of a planning or total performance competition or a selection procedure for planning or total performance studies; the following conditions must be met
1. the preceding procedure was conducted in accordance with the principles of the agreement;
2. the proposed solutions were assessed by an independent panel of experts;
3. the contracting authority reserved the right in the tender documentation to award the follow-up contract or coordination by direct award.
3 The contracting authority shall prepare documentation for every contract awarded in accordance with paragraph 2, containing the following information
a. name of the contracting authority and the successful tenderer;
b. type and value of the procured service;
c. explanation of the circumstances and conditions justifying the application of the direct award procedure.
Competitions and Study Commissions
1 The client who organizes a planning or general services competition or awards study commissions regulates the procedure in individual cases within the framework of the principles of this agreement. They may refer to relevant provisions of professional associations.
Electronic Auctions
1 The contracting authority may conduct an electronic auction for the procurement of standardised services within the framework of a procedure under this agreement. In doing so, offers are revised after an initial full evaluation and reordered using electronic aids and, if applicable, multiple rounds. This must be indicated in the invitation to tender, whereby the contract is awarded to the most advantageous offer.
2 The electronic auction extends
a. to prices, if the contract is awarded to the lowest total price; or
b. to prices and values for quantifiable components such as weight, purity or quality, if the contract is awarded to the most advantageous offer.
II G/1/2/1
3 The contracting authority checks whether the bidders meet the suitability criteria and whether the offers meet the technical specifications. It carries out an initial evaluation of the offers based on the award criteria and the weighting specified for them. Before the start of the auction, it provides each bidder with
a. the automatic evaluation method, including the mathematical formula based on the stated award criteria;
b. the result of the initial evaluation of its offer; and
c. all other relevant information for the conduct of the auction.
4 All admitted bidders are simultaneously and electronically invited to submit new or adjusted offers. The contracting authority may limit the number of admitted bidders, provided it has announced this in the invitation to tender or in the tender documents.
5 The electronic auction may comprise several consecutive rounds. The contracting authority informs all bidders of their respective rank in each round.
Dialogue
1 For complex contracts, intellectual services, or the procurement of innovative services, a contracting authority may conduct a dialogue within the framework of an open or selective procedure, with the aim of specifying the subject matter of the performance and determining and defining the solutions or approaches. The dialogue must be indicated in the invitation to tender.
2 The dialogue must not be conducted for the purpose of negotiating prices and total prices.
3 The contracting authority formulates and explains its needs and requirements in the invitation to tender or the tender documents. It also specifies
a. the procedure of the dialogue;
b. the possible content of the dialogue;
c. whether and how participation in the dialogue and the use of intellectual property rights as well as the knowledge and experience of the bidder will be compensated;
d. the deadlines and procedures for submitting the final offer.
4 The contracting authority may reduce the number of participating bidders based on objective and transparent criteria.
5 It shall document the process and content of the dialogue in an appropriate and verifiable manner.
13
II G/1/2/1
Framework Agreements
1 The contracting authority may issue invitations to tender for agreements with one or more providers with the aim of establishing the terms and conditions for services to be procured over a specific period, particularly concerning their price and, where applicable, the anticipated quantities. Based on such a framework agreement, the contracting authority may conclude individual contracts during its term.
2 Framework agreements may not be used with the intent or effect of hindering or eliminating competition.
3 The term of a framework agreement shall not exceed five years. Automatic renewal is not possible. In justified cases, a longer term may be provided for.
4 If a framework agreement is concluded with only one provider, the individual contracts based on this framework agreement shall be concluded in accordance with the terms and conditions of the framework agreement. For the conclusion of individual contracts, the contracting authority may request the respective contracting party in writing to complete its offer.
5 If, for sufficient reasons, framework agreements are concluded with several providers, individual contracts shall be concluded, at the contracting authority's discretion, either according to the terms and conditions of the respective framework agreement without a renewed call for tenders, or according to the following procedure
a.
before concluding each individual contract, the contracting authority shall consult the contracting parties in writing and inform them of the specific need;
the contracting authority shall set the contracting parties a reasonable deadline for submitting offers for each individual contract;
the offers shall be submitted in writing and shall be binding for the duration specified in the request;
the contracting authority shall conclude the individual contract with the contracting party that submits the best offer based on the criteria defined in the tender documents or the framework agreement.
5. Awarding Requirements
Terms of Participation
1 The contracting authority shall, within the framework of the award pro-
cedure and in the performance of the awarded services, ensure that the
bidder and its subcontractors comply with the terms of participation, name-
ly the requirements under Article 12, have paid due taxes and social security
contributions, and refrain from inadmissible competition agreements.
14
II G/1/2/1
2 It may require the bidder to demonstrate compliance with the terms of
participation, particularly through a self-declaration or inclusion in a reg-
ister.
3 It shall state in the tender announcement or tender documents at what
time which proofs must be submitted.
Qualification Criteria
1 The contracting authority shall definitively establish the criteria for the qualification of the tenderer in the invitation to tender or in the tender documents. The criteria must be objectively necessary and verifiable in relation to the procurement project.
2 The qualification criteria may include, in particular, the professional, financial, economic, technical and organizational capability, as well as the experience of the tenderer.
3 The contracting authority shall state in the invitation to tender or in the tender documents at what point in time which evidence must be submitted.
4 It may not make it a condition that the tenderer has already been awarded one or more public contracts by a contracting authority subject to this agreement.
Verzeichnisse
**Registers**
1 The contracting authority or the authority responsible according to statutory
provisions may maintain a register of providers who meet the requirements for
undertaking public contracts due to their suitability.
2 The following information shall be published on the federal and cantonal
internet platform
a. Location of the register;
b. Information about the criteria to be fulfilled;
c. Examination methods and registration conditions;
d. Duration of validity and procedure for renewal of the entry.
3 A transparent procedure must ensure that the submission of applications, the
examination or re-examination of suitability, as well as the entry of an applicant
into the register or their removal from the register, are possible at any time.
4 In a specific procurement project, providers not listed in a register are also
admitted, provided they furnish proof of suitability.
5 If the register is abolished, the providers listed therein shall be informed.
15
II G/1/2/1
Zuschlagskriterien
1 The contracting authority examines tenders based on performance-related
award criteria. In addition to the price and quality of a service, it may
in particular consider criteria such as suitability, deadlines, technical value,
cost-effectiveness, life cycle costs, aesthetics, sustainability, plausibility
of the tender, creativity, customer service, delivery conditions, infrastructure,
innovation content, functionality, service readiness, professional competence, or
efficiency of the methodology.
2 Outside the scope of international treaties, the contracting authority may additionally
consider the extent to which the tenderer offers training places for apprentices in
basic vocational training, jobs for older employees, or
reintegration for long-term unemployed individuals.
3 The contracting authority announces the award criteria and their weighting in the
tender notice or in the tender documents. If solutions,
solution approaches, or procedures are the subject of the procurement,
the announcement of the weighting may be omitted.
4 For standardised services, the award may be made exclusively according to
the criterion of the lowest price.
Technical Specifications
1 The contracting authority shall specify the required technical specifications
in the tender or in the tender documents. These define the characteristics of the
procurement item such as function, performance, quality, safety, and dimensions or
production processes, and regulate the requirements for labelling and packaging.
2 When defining the technical specifications, the contracting authority shall,
where possible and appropriate, rely on international standards, otherwise on technical
regulations used in Switzerland, recognised national standards or industry recommendations.
3 Specific firms or brands, patents, copyrights, designs or types, as well as
references to a specific origin or specific producers, are not permissible as technical
specifications, unless there is no other sufficiently precise or intelligible way
of describing the services and the contracting authority in this case includes
the words "or equivalent" in the tender documents. The equivalence must be
proven by the tenderer.
4 The contracting authority may provide for technical specifications for the
preservation of natural resources or for the protection of the environment.
Lots and Partial Services
1 The tenderer must submit a comprehensive offer for the procurement item.
2 The contracting authority may divide the procurement item into lots and award them to one or more tenderers.
3 If the contracting authority has formed lots, tenderers may submit an offer for several lots, unless the contracting authority has stipulated otherwise in the tender documents. It may stipulate that a single tenderer can only be awarded a limited number of lots.
4 If the contracting authority reserves the right to require tenderers to collaborate with third parties, it must announce this in the tender documents.
5 The contracting authority may reserve the right in the tender documents to award partial services.
Variants
1 Providers are free to propose variants in addition to the offer of services described in the tender. The client may limit or exclude this possibility in the tender.
2 A variant is any offer that can achieve the procurement objective in a different way than envisioned by the client.
Formal Requirements
1 Offers and applications for participation must be submitted in writing, be complete, and adhere to the deadlines specified in the invitation to tender or the tender documents.
2 They may be submitted electronically if this is provided for in the invitation to tender or the tender documents and if the requirements defined by the client are met.

1 Insofar as this information is not already contained in the invitation to tender, the tender documents shall provide information on
a. Name and address of the contracting authority;
b. The subject matter of the procurement, including technical specifications and conformity certificates, plans, drawings and necessary instructions, as well as details of the quantity requested;
c. Formal requirements and conditions for participation for tenderers, including a list of information and documents that tenderers must submit in connection with the conditions for participation, as well as any weighting of the suitability criteria;
d. The award criteria and their weighting;
e. If the contracting authority handles the procurement electronically: any requirements for authentication and encryption for the electronic submission of information;
f. If the contracting authority provides for an electronic auction: the rules according to which the auction will be conducted, including the designation of those bid elements that can be adjusted and evaluated based on the award criteria;
g. The date, time and place for the opening of tenders, if the tenders are opened publicly;
h. All other modalities and conditions required for the preparation of tenders, in particular the currency in which the tender is to be submitted (as a rule, Swiss francs);
i. Deadlines for the performance of services.
Tender Opening
1. In open, selective, and invitation procedures, all tenders submitted within the deadline shall be opened by at least two representatives of the contracting authority.
2. A record shall be made of the opening of the tenders. This record shall at least include the names of the persons present, the names of the tenderers, the date of submission of their tenders, any alternative tenders, and the respective total prices of the tenders.
3. If services and price are to be submitted in separate envelopes, the procedure for opening the envelopes shall follow paragraphs 1 and 2, with only the total prices being recorded in the minutes of the opening of the second envelopes.
4. All tenderers shall be granted access to the record upon request, at the latest after the award of the contract.

II G/1/2/1
Examination of Tenders
1 The contracting authority examines the received tenders for compliance with the formal requirements. Obvious calculation errors are corrected ex officio.
2 The contracting authority may request bidders to clarify their tenders. It records the request and the responses in writing.
3 If a tender is received whose price appears unusually low compared to other tenders, the contracting authority must obtain relevant information from the bidder as to whether the conditions of participation have been met and the further requirements of the invitation to tender have been understood.
4 If performance and price are to be submitted in separate envelopes, the contracting authority first creates a ranking list according to the quality of the tenders. In a second step, it evaluates the total prices.
Bereinigung der Angebote
**Clarification of Tenders**
1 The contracting authority may clarify the tenders with the tenderers regarding the services and the modalities of their provision in order to determine the most advantageous tender.
2 A clarification shall only take place if
a. the contract or the tenders are thereby clarified, or the tenders can be made objectively comparable according to the award criteria; or
b. changes to the services are objectively and factually necessary, whereby the subject matter of the service, the criteria, and specifications must not be adapted in a way that changes the characteristic service or the potential circle of tenderers.
3 A request for price adjustment is only permissible in connection with the conditions set out in paragraph 2.
4 The contracting authority shall record the results of the clarification in minutes.
Evaluation of Tenders
1 Provided that the suitability criteria and technical specifications are met, tenders shall be objectively, uniformly, and transparently examined and evaluated in accordance with the award criteria. The contracting authority shall document the evaluation.
2 If the comprehensive examination and evaluation of tenders requires considerable effort, and the contracting authority has announced this in the invitation to tender, it may subject all tenders to an initial examination and ranking based on the submitted documents. On this basis, it shall, if possible, select the three highest-ranked tenders and subject them to a comprehensive examination and evaluation.
20
Award
1 The most advantageous tender will be awarded the contract.
Contract Conclusion
1 The contract with the selected tenderer may be concluded after the expiration of the period for filing a complaint against the award, unless the Cantonal Administrative Court has granted suspensive effect to a complaint against the award.
2 If an appeal procedure against the award is pending without suspensive effect having been requested or granted, the contracting authority shall promptly notify the court of the contract conclusion.
1. **Termination**
1 The contracting authority may terminate the procurement procedure, in particular, if
a. it refrains from awarding the public contract for sufficient reasons;
b. no tender meets the technical specifications or other requirements;
c. more advantageous offers are expected due to changed framework conditions;
d. the submitted tenders do not allow for economic procurement or significantly exceed the cost framework;

f. a material change to the requested services becomes necessary.
2 In the event of a justified termination, the bidders are not entitled to compensation.
Exclusion from the Procedure and Revocation of Award
1 The contracting authority may exclude a bidder from a procurement
procedure, remove them from a register, or revoke an award already granted to
them if it is determined that one of the following circumstances applies to the
bidder concerned, their organs, an engaged third party, or their organs

in the procedure, or the lawful course of the procurement pro-
cedure is impaired by their conduct;

resulting competitive disadvantage for other bidders cannot be
offset by suitable means;

The contracting authority or the competent authority according to legal provisions shall report suspicion of unlawful competitive agreements according to Article 44 paragraph 2 letter b to the Competition Commission.
3 The contracting authority or the competent authority according to legal provisions shall report a final exclusion according to paragraph 1 to the InöB. The InöB shall maintain a non-public list of sanctioned tenderers and subcontractors, specifying the reasons for the exclusion and the duration of the exclusion from public contracts. It shall ensure that every contracting authority can receive the relevant information concerning a specific tenderer or subcontractor. For this purpose, it may establish a retrieval procedure. The Confederation and the cantons shall provide each other with all information collected under this Article. Upon expiration of the sanction, the entry shall be deleted from the list.
4 If a contracting authority violates this agreement, the competent authority according to legal provisions shall issue appropriate directives and ensure their compliance.
5 If financial contributions are granted for a public contract, these contributions may be wholly or partially withdrawn or reclaimed if the contracting authority violates procurement law provisions.
**7. Deadlines and Publications, Statistics**
## Deadlines
1. When determining the deadlines for submitting tenders or requests to participate, the contracting authority shall take into account the complexity of the contract, the estimated number of subcontracts, and the means of transmission.
2. In the domain of international treaties, the following minimum deadlines apply
a. in open procedures: 40 days from the publication of the tender notice for the submission of tenders;
b. in restricted procedures: 25 days from the publication of the tender notice for the submission of requests to participate and 40 days from the invitation to tender for the submission of tenders.
3. Any extension of these deadlines must be promptly communicated to all tenderers or published.
4. Outside the domain of international treaties, the deadline for submitting tenders is generally at least 20 days. For largely standardised services, the deadline may be reduced to not less than five days.
Reduction of Deadlines in the Area of International Treaties
1 The contracting authority may, in cases of proven urgency, reduce the minimum deadlines pursuant to Article 46, paragraph 2, to not less than ten days.

prior notice, the invitation to tender, the award, and the cancellation of the
procedure on an internet platform for public procurement jointly operated by
the Confederation and the Cantons. It also publishes
awards granted by direct award in the context of international treaties.
2 The tender documents are generally provided simultaneously and
electronically. Access to these publications is free of charge.
3 The organisation commissioned by the Confederation and the Cantons with
the development and operation of the internet platform may levy charges or
fees from contracting authorities, bidders, and other persons who use the
platform or related services. These are calculated based on the number of
publications or the scope of the services used.
4 For every contract in the international treaty area that is not tendered in an
official language of the World Trade Organization (WTO), the contracting
authority publishes a summary of the notice in an official language of the
WTO simultaneously with the invitation to tender. The summary shall contain at
least

4 The contracting authority may not disclose information if such disclosure would
a. violate applicable law or prejudice public interests;
b. impair legitimate economic interests of the bidders; or
c. jeopardize fair competition among the bidders.
Appeal
1 Against decisions of the contracting authorities, an appeal to the cantonal Administrative Court is permissible as the sole cantonal instance, at least from the contract value relevant for the invitation to tender procedure.
2 For appeals against procurements by the higher cantonal judicial authorities, the Federal Supreme Court has direct jurisdiction.
3 Foreign bidders are only admitted to appeal for contracts outside the scope of international treaties if the state in which they are domiciled grants reciprocity.
Object of Appeal
1 The following decisions exclusively are challengeable by appeal

b. the decision on the selection of bidders in the selective procedure;
c. the decision on the inclusion of a bidder in a register or on the removal of a bidder from a register;

27
II G/1/2/1
3 Provisions of this Agreement concerning the right to be heard in the decision-making procedure, the suspensive effect, and the limitation of grounds for appeal do not apply to appeals against the imposition of a sanction.
4 Decisions under paragraph 1 letters c and i may be challenged by appeal regardless of the contract value.
5 In all other respects, legal protection against decisions under this Agreement is excluded.
6 Appeals against the conclusion of individual contracts under Article 25 paragraphs 4 and 5 are excluded.
Suspensive Effect
1 The appeal does not have a suspensive effect.
2 The cantonal administrative court may, upon request, grant suspensive effect to an appeal if the appeal appears to be sufficiently substantiated and no overriding public interests are opposed. Regarding the question of suspensive effect, a written exchange of pleadings usually takes place.
3 A request for suspensive effect that is abusive of rights or contrary to good faith will not be protected. Claims for damages by the contracting authority and the considered bidder are to be assessed by the civil courts.
Applicable Law
1 The decision-making procedure and the appeal procedure are governed by the provisions of the cantonal laws on administrative justice, unless otherwise provided by this agreement.

File Inspection
1. In the award procedure, there is no right to file inspection.
2. In the appeal procedure, the appellant shall, upon request, be granted access to the evaluation of their offer and to other procedure files relevant to the decision, provided that no overriding public or private interests preclude it.
Decision on Appeal
1 The appellate body may decide the matter itself or refer it back to the lower instance or to the contracting authority. In the event of a referral back, it must issue binding instructions.
2 If the appeal is found to be justified and the contract with the considered tenderer has already been concluded, the appellate body shall determine to what extent the contested decision violates the applicable law.
3 Simultaneously with the determination of the legal violation, the appellate body shall decide on any claim for damages.
4 Damages are limited to the necessary expenses incurred by the tenderer in connection with the preparation and submission of its offer.

4 The KBBK may prepare expert opinions or commission experts to do so.
5 It adopts its own rules of procedure. These require the approval of the Federal Council and the FDP.

1 The Cantons monitor compliance with this Agreement.
2 The InöB processes reports from Cantons concerning compliance with this Agreement by other Cantons.
3 Private individuals may address reports concerning compliance with this Agreement by the Cantons to the InöB. Such a report confers neither party rights nor a right to a decision.
4 The InöB shall issue regulations for this purpose.
