### Amount of Retirement Pension or Disability Pension

1 Retirement and disability pensions are based on the last statutory salary received, including cost-of-living allowances. Other compensation, allowances, or daily allowances are not taken into account. However, the salary relevant for the calculation of benefits shall not exceed the respective maximum insured salary of the Civil Servants' Insurance Fund.

2 The retirement pension from the eighth year in office amounts to 48 percent of the salary and increases by 3 percent with each additional full year in office, reaching a maximum of 60 percent after twelve years of service.

3 In the event of retirement in the first year in office, the disability pension amounts to 34 percent of the salary, increases by 2 percent with each full year in office, reaches 48 percent upon completion of the eighth year in office, and is then equal to the retirement pension.

4 Retirement pensions and disability pensions shall be adjusted to the cost-of-living index to the same extent as the pensions of the Civil Servants' and Teachers' Insurance Fund.

Survivors' Pension for Widows and Children

1 If a person entitled to benefits under Article 1 dies, his widow shall be entitled, from that date and for the duration of her widowhood, to a pension of 60 percent of the retirement pension or invalidity pension. The children of the deceased beneficiary shall receive an orphan's pension of 20 percent each, and if they are full orphans, 30 percent each, of the retirement pension or invalidity pension.

2 The following shall be used as a basis

a. in the event of the death of an incumbent beneficiary, the pension which he could have claimed if he had retired due to invalidity on the day of his death (Art. 2 para. 2);

b. in the event of the death of a beneficiary who has retired from office, the benefits most recently received by him or the retirement pension to which he would have been entitled after reaching the age of 60 (Art. 2 para. 1 last sentence).

3 Children are entitled to benefits until they have reached the age of 20 and, if they are in education and have no income of their own, or are unable to earn their living due to mental or physical infirmities, until they have reached the age of 25.

4 The combined pensions for the widow and children may not exceed 100 percent of the benefits according to paragraph 2 letter a or b, respectively.

Financing

1 Incumbent beneficiaries according to Article 1 shall pay an annual premium of 6 percent of the salary creditable under Article 3 paragraph 1; the Canton shall pay a premium of 12 percent. These premiums shall accrue to the State Treasury, which shall maintain a separate account for them.

2 Should this premium account be insufficient to cover the payment of due benefits, further expenses shall be charged to the income statement. The necessary appropriations shall be included in the budget each time.

3 If, upon leaving office, there is no entitlement to benefits under this ordinance, the personally paid premiums shall be refunded; furthermore, the Canton shall pay a one-time severance amount equivalent to one month's salary per year in office.

In this case, there shall be no entitlement to benefits under this law.
