Table of Provisions (31)
Statutory Text (31 Provisions)
1. The Municipal Council of Glarus Nord, based on the Federal Act on the Business of Travellers and its corresponding Ordinance, the Cantonal Act on Trade Police, and Article 86 lit. b of the Municipal Act, issues the Market Regulations for the Municipality of Glarus Nord. Market affairs within the entire municipal area are subject to the supervision of the Municipal Council, which appoints the Social Affairs Department for this purpose.

If the "Chilbifäller" itself falls on a Sunday, the Chilbi takes place on that day (with the exception of Oberurnen, in which case the Chilbi is postponed by one week, so it always effectively takes place on the last weekend of August [like Sound of Glarus]). 1. Stalls/Pitches

1. The Kerenzen Fair (Chilbi Kerenzen) takes place annually, alternating between Mühlehorn, Obstalden, and Filzbach. The fair is very small-scale and is primarily organized by local associations – there is only very limited space available for external market vendors. Any interested parties are referred to the respective market manager.
2. Mühlehorn

3. Obstalden

4. Filzbach

1. The implementation times for the various markets differ and can be found in Appendix 3. The operating hours for showmen and rides are governed by separate contractual agreements.
1. The erection of market and sales stands is permitted only in the designated areas and must be carried out according to the instructions of the Market Manager. The prescribed sales fronts must be observed (emergency access lane).
1. The market is open to everyone who submits to the provisions of these market regulations for the sale of registered goods and services. When granting permits, attention must be paid to a balanced and market-oriented offering.
2. Admission may be refused if
a) the market area is insufficient to accommodate all applications;
b) the application was submitted too late or not at all;
c) there is an oversupply of the article in question;
d) the applicant does not guarantee a proper exercise of the market trade;
e) the applicant has previously failed to pay a pitch fee.
3. If several market traders apply with a similar offering, existing applicants shall be given preference, provided their impeccable business conduct is demonstrated. The market manager may prohibit persons who do not comply with the market regulations, violate these market regulations, or cause public nuisance, from selling goods and may expel them from the premises.
1. Registrations must be submitted in writing (mail or e-mail). The registration deadline is generally (with the exception of Grämplitag) three months before the respective "Chilbifäller" (Oberurnen, Niederurnen, Näfels, Mollis, and Bilten) or before the event takes place (Näfelser Fahrt and Kerenzen). The dates are listed in Annex B. Registrations received after this deadline will no longer be considered.
2. Confirmations and rejections will generally (with the exception of Grämplitag) be confirmed in writing by the Market Commission up to one month after the registration deadline.
3. The registration must accurately declare all sales articles as well as the dimensions of the sales stand and the electricity requirements.
1. Anyone wishing to participate in the market requires a written permit (confirmation) as well as proof of payment for the stall/pitch fee. The former is issued by the Market Commission. Market traders must have paid the invoice for the stall pitch no later than 14 days before the Chilbi fair. The Market Manager is not authorized to issue permits independently; they are obliged to refuse market traders who do not possess a written permit.
1. Regarding allocated stalls that are not occupied by 08:00 AM on market day, the Market Manager may dispose of them otherwise. No claim for compensation exists.
2. In the event of a justified impediment, a cancellation must be received in writing or by telephone no later than 48 hours before the market begins. For later cancellations or no-shows on market day, the pitch rent becomes due for payment.
3. Assigned stalls and pitches may not be transferred to third parties without the permission of the Market Manager.
1. Local businesses may participate in the market under the same conditions. A placement in front of one's own business cannot be guaranteed. For carts or stalls within the market area that are not located in front of one's own business, the pitch rent will be due.
2. On market day, businesses must tolerate market stalls even in front of their display windows.
3. In the interest of maintaining a genuine goods market, the Market Commission may limit the admission of associations, political, cultural, or charitable institutions.
4. Local associations and community-based organizations are exempt from pitch rent.
1. The duration of the merchandise market as well as the sales times vary from event to event and can be found in Annex C. The times are binding. It is prohibited to drive vehicles into the market area before sales close, as well as at the start of the market before the diversions have been set up.
2. The parking of vehicles or loading goods in the market area must be carried out according to the instructions of the market manager. Unloaded vehicles must be removed from the market area before the start of the market.
1. For the use of the pitches, the Municipal Council, upon application by the Market Commission, shall determine the fee tariff (price per linear meter). The pitch fees are listed in Annex D.
2. It is generally expected that market traders bring their own market stalls or vehicles. Municipal market stalls will only be provided for associations or community-related institutions. The corresponding market stall fees can also be found in Annex D.
1. After market close, the market traders must clear their stalls and pitches and ensure order in the immediate vicinity of the sales area.
2. Nothing may be left behind. Waste must be taken away.
1. Amusements and entertainment establishments are subject to the Federal Act on Itinerant Trade and its associated ordinance.
2. The Market Commission concludes separate contracts with the showmen.
1. All foodstuffs offered on the market are subject to federal and cantonal food and meat inspection ordinances, as well as cantonal food control.
2. The provisions of the Animal Epidemics Ordinance remain reserved.
3. The provisions listed in the Ordinance to the Law on the Business of Travelers regarding goods whose distribution is restricted or prohibited at markets apply, in particular, no alcoholic beverages may be dispensed openly.
4. Federal and cantonal regulations concerning weights and measures must be observed.
5. Every market participant must label their sales stand in a clearly visible place with a sign of at least 20 cm × 40 cm displaying their name and address.
6. All goods offered must be clearly and unambiguously priced in CHF.
7. Every market trader must have adequate liability insurance for their business. The market municipality is not liable for damages that may arise from a short-notice, justified cancellation due to force majeure.
1. Whoever disregards the provisions of these Market Regulations or the directives of the competent officials will
a) be warned in minor cases
b) be expelled from the market in serious cases
2. In the event of repeated violations, a market trader may be barred from further market visits in the municipality. The provisions of federal and cantonal law remain reserved.
1. In the event of changes in the market system of the municipality of Glarus Nord, the Swiss Market Association (SMA) will be included in the consultation process.
1. Commitments, rejections, and any directives from market authorities in public service are administrative decisions. Objections to such decisions may be filed in writing with the municipal council within 20 days.
