Art. 51 CCP · Retirement by Operation of Law
1. If the employee has reached the maximum retirement age, the employment relationship automatically ends.
2. The maximum retirement age is determined in the implementing provisions. It may vary for certain personnel categories.
3. The State Council may, by regulation, stipulate that the employee, with the agreement of the employer, can continue the employment relationship beyond the maximum retirement age. Paragraph 5 remains reserved.
4. The employment relationship legally ends at the end of the month in which the employee reaches the maximum retirement age, or at the agreed-upon time if the employment relationship is extended beyond the maximum age. If the nature of the position requires it, particularly in the case of teaching staff, the implementing provisions may specify a different date.
5. In special cases, the State Council, in agreement with the employee, may postpone the termination of the employment relationship beyond the maximum age according to paragraph 2, but no later than up to the age of 70.
