Ordinance on the Fund for the integration of people with disabilities into the working world - Purpose

**1. The Fund for the Labor Market Inclusion of People with Disabilities (the Fund) is used for financing:**

a) Support measures for companies that enable them to offer job opportunities to a person with disabilities who resides in the Canton of Fribourg and receives a disability pension or has permission to work in a workshop of a special or social pedagogical institution;

b) The assessment, clarification, and coordination aimed at concluding an employment contract between the company and the person with disabilities.

1. The fund shall be financed by

a) the social contribution as per Article 3, paragraph 1, letter d of the Law of December 13, 2018, regarding the implementation of the tax reform[1];

b) bequests and donations;

c) the income from the assets of the fund;

d) any other resources that may be allocated to it.

1. The fund may finance

a) Infrastructures or aids that are not covered by disability insurance or another insurance;

b) Training and further education for company personnel who will collaborate with a person with disabilities;

c) Coaching services for the person with disabilities and the other company personnel.

1. The Fund finances one or more mandates to ensure the services pursuant to Article 1 paragraph 1 letter b for the entire canton.

2. The mandate or mandates are issued by the Directorate for Health and Social Affairs.

3. The annual funding for these mandates may not exceed 50% of the social contribution pursuant to Article 2 paragraph 1 letter a.

4. The mandate or mandates may include the following services

a) Assess the resources and needs of each person with disabilities;

b) Develop an occupational project for them;

c) Seek a position in a company that corresponds to their resources and needs;

d) Establish contact with companies in the canton, namely

1. contact the companies;

2. analyze their potential for creating jobs;

3. explain how they can receive financial support from the Fund;

e) Regularly assess the situation with the person with disabilities and the reference persons in the company.

1. The amounts allocated annually for all support measures under Article 3 must be proportionate to the available funds to ensure the sustainability of the fund.

2. The financing of support measures may not exceed the following amounts per individual dossier

a) 10,000 Swiss Francs for infrastructure or auxiliary resources (lump sum);

b) 100 Swiss Francs per hour of training and further education for company personnel, for up to a maximum of 5 hours per dossier; this amount includes the costs for preparation for these courses and travel expenses;

c) 100 Swiss Francs per coaching hour, for up to a maximum of 60 hours per dossier and year.

1. The fund is managed by the Social Welfare Authority (SWA): It is included in the state's balance sheet.

2. The Financial Inspectorate supervises the fund's accounts.

1. Companies must submit individual applications to the SVA for the granting of support measures in accordance with Article 3; for this purpose, they shall use the designated form.

2. The applications can be renewed.

1. The Director of the Directorate of Health and Social Affairs decides on the financing of support measures and communicates their decision in writing.

2. In the event of a negative decision, reference is made to the right to request a formal decision in accordance with the provisions of the Administrative Procedure Act.

3. Allocations from the fund are made according to the available financial means. There is no legal entitlement to a contribution.
