Agreement on the Organization of the Secretariat of the Responsible Body for the Basel Agglomeration Programme - Principle

1. The Office is part of the sponsorship for the Agglomeration Program of the Basel Agglomeration. It consists of

a) the Head of the Agglomeration Program and

b) an employee.

2. The Office is staffed with up to 200% of employment percentages.

3. The management of the sponsorship for the Agglomeration Program of the Basel Agglomeration may apply for the appropriate expansion of the Office with the Cantons of Basel-Stadt and Basel-Landschaft as needed.

1. The Head of the Construction and Environmental Protection Directorate of the Canton Basel-Landschaft and the Head of the Construction and Transport Department of the Canton Basel-Stadt are responsible for selecting the staff of the office. The formal hiring authority is the Council of State of the Canton Basel-Landschaft.

2. The staff of the office is subject to the personnel law of the Canton Basel-Landschaft.

1. The office is located in Liestal.

2. It is administratively assigned to the Office for Spatial Planning within the Directorate of Construction and Environmental Protection of Basel-Landschaft.

3. The office is professionally subordinate to the management of the sponsoring body of the Agglomeration Program for the Basel agglomeration and is bound by its directives. The management prepares a specification document for the office, which must be approved by the political steering committee.

4. The office manages the secretariat of the political steering committee.

1. The costs for the office are borne equally by the two Cantons of Basel-Stadt and Basel-Landschaft, each contributing 50%. The costs include personnel expenses (including fees), space expenses (including IT infrastructure), and material expenses. The costs to be shared are calculated by multiplying the gross salary costs by a factor of 1.6. The calculation scheme is set forth in Appendix 1.

2. The financial obligations of the Cantons are subject to the necessary funding resolutions of the respective competent bodies. Within this framework, the parties may jointly agree, on a case-by-case basis or generally, to an arrangement deviating from the cost-sharing set out in paragraph 1.

3. The costs are pre-financed by the Canton of Basel-Landschaft and billed monthly to the Canton of Basel-Stadt.

1. This agreement is concluded for an indefinite period.

2. It may be terminated by either of the cantons with a two-year notice period at the end of a calendar year. Should this occur, the two cantons must provide an alternative arrangement that meets the requirements for obtaining federal contributions to the agglomeration program.

3. If there are significant changes in the contract between the cantons of Basel-Stadt, Basel-Landschaft, Aargau, and Solothurn concerning the management of the Basel Agglomeration program that affect the office, this agreement must be reviewed for its validity and continuity, and adapted if necessary.

1. This Agreement must be approved by the District Council of the Canton of Basel-Landschaft. It becomes effective immediately upon mutual signing and approval by the District Council. The Agreement is to be published.
