Agreement between the Canton of Basel-Stadt and the Canton of Basel-Landschaft concerning the Relocation of the Cantonal Border at Margarethenstich

1. The existing cantonal boundary between Basel-Stadt and Basel-Landschaft is relocated according to the delineation in the boundary regulation plan of August 26, 1965, which has been signed by the cantonal surveyors of both cantons.

2. In this manner, 429 m² from each of the two cantonal areas is allocated to the other.

1. From the territory of the Canton of Basel-Stadt, the area of 429 m² highlighted in yellow in the boundary regulation plan, formerly part of the common land of Margarethenstich, owner: Municipality of the City of Basel, is ceded and incorporated into the territory of the Canton of Basel-Landschaft. This area will be removed from the common land and subjected to private legal transactions. It shall be merged with parcel 1785 of the land register of the Municipality of Binningen.

From the territory of the Canton of Basel-Landschaft, the area depicted in red in the border regulation plan, measuring 429 m²—of which 401 m² was previously part of parcel 1785 of the land register of the municipality of Binningen and 28 m² was previously part of parcel 1815 of the land register of the municipality of Binningen (common land of Friedhofstrasse)—is separated and added to the territory of the Canton of Basel-Stadt.

2. Both sections are declared as common land (common land of the Margarethenstich).

3. The separation of the 28 m² piece of common land by the residential municipality of Binningen to the common land of the residential municipality of the city of Basel occurs without compensation.

1. The course of the new cantonal boundary is determined by the specified dimensions indicated on the plan and by the coordinates calculated from these dimensions.

1. The staking out and marking of the new boundary points shall be carried out by the Surveying Office of Basel-Stadt. The costs for mutation and marking shall be borne equally by the two cantons.

1. The municipal community of Binningen is to be requested for their consent to this agreement, particularly concerning the proposed adjustment of the municipal boundary.

1. The Land Registry Office Binningen is authorized to make the corresponding entries.

1. The agreement and the accompanying boundary regulation plan are to be prepared in ten copies each.

2. One copy is to be submitted to the Swiss Federal Council for acknowledgment.

3. The convention shall enter into force immediately.
