Ordinance on the fees of the office for military and civil protection concerning shelters - Scope

1. This regulation governs the fees of the Office for Military and Civil Protection (AMB) for activities concerning shelter construction obligation and shelter management.

1. The AMB charges fees for the following activities

a. Applications and procedures of non-public institutions for contributions from the shelter replacement levy fund;

b. Orders concerning replacement levies in lieu of the obligation to construct shelters for new residential buildings and residential developments;

c. Examination of construction projects concerning the shelter obligation, which entail special effort.

2. Liable for fees are private property developers (natural and legal persons) as well as applicants for contributions from the shelter replacement levy fund.

1. The fees are as follows

a. Procedures involving contributions from the Protective Space Compensation Fund, basic fee 100 francs; for complex procedures, an additional charge per hour of 80 francs for extra effort;

b. Applications concerning compensation fees for residential buildings and residential developments with up to and including 24 shelter places, 200 francs;

c. Applications concerning compensation fees for residential buildings and residential developments, whether realized or not, with more than 24 shelter places, a basic fee of 200 francs and an additional charge per hour of 80 francs for extra effort.

1. No fees are charged for activities involving

a. protective structures and shelters that belong to the canton or municipalities, or that are constructed and financed together with private builders by the canton or the municipalities;

b. nursing homes and care facilities of the municipalities or charitable institutions that are listed on the canton's list of care homes.

2. In insignificant cases where the effort involved is less than one hour, the imposition of fees is waived.

1. This Regulation shall enter into force on October 1, 2012.
