Statutory Text (6 Provisions)
1. This Framework Agreement contains general rules related to the transition of the municipality of Moutier (hereinafter: "Municipality of Moutier") to the canton of Jura, which apply to all implementation agreements.
Provisions to the contrary under federal law and the implementation agreements are reserved. The same applies to additional agreements between the authorities of both cantons.
1. This framework agreement applies to cantonal, communal, and quasi-governmental authorities or bodies that perform public duties for the Canton of Bern or the Canton of Jura in the context of the implementation of the Moutier Concordat and related execution agreements.
The authorities or bodies mentioned in Article 2 remain debtors of their debts and holders of their claims, regardless of their origin.
1. The competent Jura authorities or the municipality of Moutier may, if they deem it appropriate, issue orders from the date of entry into force of this framework agreement that affect the territory of the municipality of Moutier from the time of the municipality's change of cantonal affiliation.
2. With regard to these early orders and the legal remedies related thereto, Jura law shall apply.
1. Upon the entry into force of this framework agreement, the competent authorities of Jura are authorized to take instructional actions in the territory of the Municipality of Moutier to handle administrative law proceedings related to the orders mentioned in Article 4.
2. The competent authorities of Bern are authorized, after the date of the cantonal change, to take instructional actions in the territory of the Municipality of Moutier to handle administrative law proceedings that are pending with them at that time.
3. The right pursuant to paragraph 2 expires one year after the date of the cantonal change. After the expiration of this period, only the avenues of legal or mutual assistance remain available.
4. Concerning the instructional actions, the law applicable to the corresponding proceedings shall apply. The same principle applies to the legal process.
