Provisional Ordinance on the Introduction of the Federal Act on Protection against Dangerous Substances and Preparations - Competencies
Statutory Text (4 Provisions)
1. The Executive Council exercises the supreme supervision, and the Department of Construction and Economic Affairs supervises the enforcement of federal legislation regarding the protection against hazardous substances and preparations. The Department may issue directives.
2. The Office for the Environment is the specialist agency responsible for executing the powers and duties assigned to cantonal enforcement authorities under federal legislation concerning the protection against hazardous substances and preparations, insofar as no other competencies are defined. It may consult other specialist agencies.
3. The Executive Council may agree with other cantons on the joint fulfillment or delegation of enforcement tasks.
1. The legal protection is subject to federal legal provisions in accordance with the Administrative Procedure Act.
1. The Ordinance of November 13, 1972, concerning the Federal Act of March 21, 1969, on the Traffic of Poisons (Poison Act) is repealed.
1. This Regulation shall enter into force on 1 October 2005.
