Article 2 Act on the Organisation of Judicial Authorities (Judicial Organisation Act, GOG) (Gerichtsorganisationsgesetz, GOG) - Independence of Judicial Authorities

1. The judicial authorities are independent and committed to the law and justice.

2. In the administration of justice, the lower courts are independent from the higher courts. They are not to receive legal instructions.

3. However, in cases of remand, the lower court is required to base its new decision on the legal assessment provided in the remand order.
