Regulations on the Fund for Uninsured Risks of Cantonal Administrative and School Enterprises and the Psychiatric Services of Graubünden - Purpose

1. For the partial or full coverage of damages arising from uninsured risks of the cantonal administrative and educational operations as well as the Psychiatric Services of Graubünden, which the canton or the Psychiatric Services of Graubünden are obliged to assume or choose to assume voluntarily, a fund exists (Account 997.000).

1. The administration of the fund manages the accounting records. The assets are interest-bearing at the average interest rate for long-term capital investments.

1. For the coverage of damages as defined in Article 1, interest income and portions of the assets may be used. Unused interest will be added to the assets.

1. Applications for benefits from the fund must be submitted in writing to the Department of Finance and Municipalities.

2. The authority to decide regarding the total claimed damage for an incident is vested in the following instances

a) * up to 50,000 francs with the Department of Finance and Municipalities;

b) * over 50,000 francs with the government.

3. The judgment of the judge pursuant to the Liability Law[1] remains reserved.

1. In assuming liability for damages within the meaning of Article 1 and in assessing the compensation, the fault of the injured party and the special circumstances of the case must be appropriately taken into account.

1. This regulation comes into force on September 1, 1963.
