6 B 13/14, 6 B 13/14 (6 C 41/14) — Discretionary assessment in determining efficient service provision costs under the Telecommunications Act
Decision Summary (Facts, Holding & Outcome)
AI generatedThe Federal Administrative Court (BVerwG) granted the intervenor's complaint and admitted the appeal on points of law, thereby permitting the case to proceed to the merits in revision. The dispute concerns telecommunications regulation, specifically the Federal Network Agency's determination of costs for efficient service provision and the hourly rates underlying one-time charges. The court held that the case possesses fundamental legal significance (§ 132 Abs. 2 Nr. 1 VwGO) because it requires clarification on whether and to what extent the Telecommunications Act (TKG) grants the regulatory authority a margin of discretion in these calculations and what judicial review standards apply. The decision is based on the provisions for efficient service provision costs under § 31 Abs. 2 Satz 1 and § 32 Abs. 1 Satz 1 TKG.
