RRE Nr 387 — Tenancy Law Commission Procedural Violation Over Appeal Standing and Notification

Case Number RRE Nr 387 (LU_RR_001_RRE-Nr--387_1992-02-18)
Court / Authority
Decision Date
Outcome Partially Allowed
Jurisdiction Canton of Lucerne — Cantonal Courts (CH-LU)

Decision Summary (Facts, Holding & Outcome)

AI-structured

The reviewing authority determined that a decision by the Tenancy Law Commission violated procedural law requirements derived from the constitutional guarantee against arbitrariness and the principle of legal equality, which mandate adherence to the provisions of the Cantonal Law on Administrative Court Procedure. Specifically, the Commission failed to explicitly examine the standing of the cooperative entity that had filed an appeal, omitted a ruling on that appeal as required by law, and further failed to serve the decision upon that entity, thereby breaching mandatory notification and reasoned decision-making standards.

Rechtsprechung Luzern =====================

Instanz: · Regierungsrat Abteilung: · - Rechtsgebiet: · Verfahren Entscheiddatum: · 18.02.1992 Fallnummer: · RRE Nr. 387 LGVE: · 1992 III Nr. 1 Leitsatz: · Verfahren vor der Pachtrechtskommission. Art. 4 BV; §§ 108 Abs. 2, 110 Abs. 1 c, 112 Abs. 1 VRG.
