The Court of Cassation declared the appeal inadmissible because it merely repeated grievances already addressed by the Court of Appeal without presenting new legal arguments. The appellant challenged the conviction for a specific crime, arguing violations regarding sentencing continuations, elements of the offense, and mitigating circumstances. The court rejected these claims as legally unfounded and procedurally exhausted, ordering the appellant to bear the costs of the proceedings.

Art. 385, cod. pen.; Art. 600 c.p.p.: An appeal to the Court of Cassation is inadmissible if it substantially reproduces grievances already examined by the appellate court with a non-manifestly illogical and legally correct decision, as no new grounds for cassation exist.

CONSIDERATO IN DIRITTO

385, cod. pen.. Egli deduce violazione di legge e vizi di motivazione in tema di:

1) diniego della continuazione con analoghi reati separatamente giudicati;

2) elemento oggettivo e soggettivo del reato;

3) esclusione della particolare tenuità del fatto (art. 131-bis, cod. pen.);

4) diniego dell'attenuante di cui all'art. 385, quarto comma, cod. pen., e delle attenuanti generiche.

Corte Cost., sent. n. 186/2000).
