The Court of Cassation declared the appeal by Erik Grillo inadmissible, confirming his conviction for the crime under Article 385 of the Penal Code. Grillo argued for a logical flaw in the lower court's reasoning regarding the particular lightness of the offense under Article 131-bis, but the court found this to be a challenge to the substantive merit of the fact-finding. Consequently, the appeal was rejected because reviewing the weight assigned to factual data constitutes a challenge to the appellate judges' evaluation of the case, which is not subject to review at this stage.

SATI;RITENUTO IN FATTO E

CONSIDERATO IN DIRITTO

Corte Cost., sent. n. 186/2000).
