Ärakiri Kohtuasi nr 4-08-8542

KOHTUOTSUS Eesti Vabariigi nimel

01.09. 2008 lõpposa

Viru Maakohtu kohtunik Tiit Kullerkupp, sekretäri Aile Siil juuresolekul, arutas avalikul kohtuistungil 01.09.2008 Rakvere kohtumajas väärteoasja OLEG ORGUS’e süüdistuses KarS § 218 lg1 järgi väärteoprotokolli AB 1048015-8193 alusel . Istungist võttis osa menetlusalune isik Oleg Orgus (isikukood 35705075223 elukoht puudub ) ja Ida Politseiprefektuuri Rakvere Politseiosakonna esindaja Asko Tasane, tunnistuse alusel. Juhindudes väärteomenetluse seadustiku § 107 lg.1 p1; 108; 111; 113, kohus otsustas:

OLEG ORGUS süüdi tunnistada KarS § 218 lg1 järgi ja karistuseks mõista arest 7 (seitse) ööpäeva. Karistuse kandmise aja alguseks lugeda väärteoasjas nr 4-08-8540 määratud aresti ärakandmisele järgnev päev. Kohtuotsuse peale on pooltel õigus esitada apellatsioonikaebus Viru Ringkonnakohtule Viru Maakohtu kaudu. Apellatsiooniõiguse kasutamise soovist tuleb kohtule teatada 7 päeva jooksul alates kohtuotsuse lõpposa kuulutamisest. Apellatsioon esitatakse kohtule 15 päeva jooksul alates päevast, mil kohtuotsus on pooltele kohtus tutvumiseks kättesaadav.
