The Federal Administrative Court (BVerwG) admitted the plaintiff's revision appeal to the higher court, finding the complaint against the lower court's refusal well-founded. The dispute concerns a damages claim for allegedly unlawful failure to promote a civil servant, specifically raising the question of how to assess hypothetical causality when the appointment of bundle positions is governed by provisions in the budget's place-of-service note that link to specific dwell times. The decisive legal basis for admitting the appeal is § 132 Abs. 2 Nr. 1 VwGO, as the issue was deemed to be of fundamental legal significance.
