The Federal Administrative Court admitted the revision, ruling in favor of the plaintiff (civil servant) and finding his complaint well-founded. The dispute centered on the validity of a regulation in the Federal Allowance Ordinance that restricted health allowance payments for civil servants with private "basic tariff" insurance to the flat rates agreed upon under § 75(3b) of the Fifth Book of the Social Code (SGB V). The court determined that the appeal raised a question of fundamental significance requiring clarification on whether this restriction is legally ineffective due to a lack of sufficient statutory authorization, violating the legal reservation principle. The key legal basis for the admission is § 132(2)(1) of the Administrative Court Procedure Act (VwGO), citing the need to assess the validity of § 6(5) Sentence 1 of the Federal Allowance Ordinance against constitutional requirements.
