The Federal Administrative Court admitted an appeal as a legal review (Rechtsbeschwerde) and ordered the proceedings to continue under a unified case number, effectively allowing the appeal to proceed without deciding the merits. The dispute concerned whether substitute members of a youth representation body who stepped in for absent regular members were entitled to protection against continued employment termination (Weiterbeschäftigungsschutz). The admission was granted to resolve conflicting jurisprudence between the Federal Administrative Court and the Federal Labor Court regarding the scope of this protection for substitute representatives under public service law. The decisive legal basis was § 9 of the Federal Personnel Representation Act (BPersVG), interpreted in conjunction with §§ 83, 72, and 92 of the BPersVG and the German Labour Court Act (ArbGG).
