The Federal Administrative Court ordered the discontinuance of the revision proceedings, leaving the lower appellate court's judgment in force, after the plaintiff withdrew her appeal with the defendant's consent. The dispute arose from the plaintiff's attempt to reverse an administrative court decision, during which a party joined as a third party filed a formal objection to the withdrawal. The court held that the objection was procedurally irrelevant because a third party possesses only a dependent procedural status; under §§ 66 and 92(3) VwGO, a third party is limited to filing substantive applications and lacks the authority to prevent the termination of the litigation or the withdrawal of the main party's appeal, a limitation that applies even in cases of necessary joinder.

Zur Stellung des Beigeladenen

[GRUENDE]

November 1991 - BVerwG 4 C 27.90 - NVwZ-RR 1992, 276; Beschluss vom 7. Juni 1968 - BVerwG 4 B 165.67 - NJW 1968, 2395).
