The Federal Administrative Court admitted the legal appeal of the employer, converting the proceedings into a full legal appeal review (Aktenzeichen 6 P 6.13) to resolve a conflict in case law; the case involves a dispute over whether substitute youth committee members who stepped in due to a principal's absence are entitled to continued employment protection under § 9 of the Public Employment Relations Act (BPersVG); the key legal issue is the interpretation of § 9 BPersVG in conjunction with § 83 BPersVG, § 72 Abs. 2 Nr. 1, and § 92 Abs. 1 Satz 2 ArbGG, specifically reconciling divergent prior rulings from the Federal Labour Court and earlier Federal Administrative Court decisions regarding the scope of protection for such representatives.
