The Federal Administrative Court (BVerwG) allowed the plaintiff’s appeal and admitted a revision on grounds of fundamental legal importance, effectively halting the lower court’s dismissal and directing the appellate proceedings for a final substantive ruling. The dispute concerned a student’s application for the recalculation of Basic Education Allowance (BAföG) benefits, specifically challenging the determination of the standard deduction for social security expenses when professional circumstances change. The decisive legal issue centers on the correct calculation of the flat-rate amount under § 21 Abs. 2 BAföG in conjunction with the provisions for updating applications based on altered professional conditions under § 24 Abs. 3 BAföG, as well as the procedural admissibility of a revision under § 132 Abs. 2 Nr. 1 VwGO.
