The Federal Administrative Court admitted an appeal on points of law, granting the plaintiff's request for legal status to challenge the denial of state health benefits, thereby ruling in favor of the applicant at the procedural stage. The dispute concerned whether expenses for heterologous in-vitro fertilization are eligible for reimbursement as necessary health treatment under public service employee welfare schemes. The decisive legal basis is § 132 Abs. 2 Nr. 1 VwGO, under which the appeal was admitted due to the question's fundamental significance, leaving the substantive issue of whether such medical procedures qualify for *Beihilfe* to be determined on the merits.
