The Federal Administrative Court (BVerwG) granted the complainant's motion, finding that the case possesses fundamental significance, and thereby admitted the appeal for revision. The dispute concerns a challenge to the enforcement of the general licensing prohibition for sports betting under § 4 Abs. 1 Sentence 1 of the Gambling Tax Act (GlüStV). The decisive legal issue to be resolved in the upcoming revision proceedings is whether the licensing requirement serves as a complete ban on organizing or mediating sports bets only when the applicant's lack of eligibility for a license has been conclusively established.
