The Federal Administrative Court (BVerwG) dismissed the defendant’s implicit opposition and allowed the plaintiff’s complaint against the non-admission of revision, thereby admitting the appeal on grounds of fundamental significance. The dispute centers on the revocation of an academic degree under § 35 Abs. 7 Satz 1 of the Baden-Württemberg State University Act (LHG), which conditions such revocation on "unworthy conduct." The court determined that the case possesses fundamental significance because it requires clarification of which interpretive guidelines for the term "unworthy conduct" derive from the academic freedom and labor protection guarantees in Art. 5 Abs. 3 Satz 1 and Art. 12 Abs. 1 Satz 1 of the German Basic Law, as well as the constitutional principle of proportionality, specifically regarding a science-related definition of unworthiness. Consequently, the revision proceedings are to be heard to establish these legal parameters.

Entziehung des Hochschulgrades; unwürdiges Verhalten

[GRUENDE]
